Ryzyko to zosta\u0142o ostatnio istotnie ograniczone w uj\u0119ciu czasowym.<\/p><p>Zgodnie z regu\u0142ami wprowadzonymi w ostatniej nowelizacji prawa budowlanego, kt\u00f3ra wesz\u0142a w\u00a0\u017cycie z dniem 19 wrze\u015bnia 2020 r., stwierdzenia niewa\u017cno\u015bci decyzji o pozwoleniu na budow\u0119 oraz o pozwoleniu na u\u017cytkowanie b\u0119dzie mo\u017cna dokona\u0107 jedynie przez okres 5 lat (w wypadku decyzji o pozwoleniu na budow\u0119 od dnia dor\u0119czenia lub og\u0142oszenia decyzji, a\u00a0w\u00a0odniesieniu do decyzji o pozwoleniu na u\u017cytkowanie \u2013 od dnia, w kt\u00f3rym decyzja sta\u0142a si\u0119 ostateczna). Jak wcze\u015bniej pisali\u015bmy, powy\u017csza ochrona dotyczy pozwole\u0144 nowych, jak i pozwole\u0144 wydanych w przesz\u0142o\u015bci.<\/p><p>Post\u0119powanie niewa\u017cno\u015bciowe, jak ka\u017cde post\u0119powanie administracyjne, ma charakter dwuinstancyjny, co jest zgodne z jedn\u0105 z\u00a0podstawowych zasad polskiego postepowania administracyjnego (zasada dwuinstancyjno\u015bci \u2013 art. 15 KPA), gwarantuj\u0105c\u0105 stronom mo\u017cliwo\u015b\u0107 dost\u0119pu do weryfikacji poprawno\u015bci ka\u017cdej decyzji przez organ drugiej instancji. W\u00a0post\u0119powaniu dotycz\u0105cym pozwolenia na budow\u0119 organem pierwszej instancji (wydaj\u0105cym \u201epierwsz\u0105 decyzj\u0119\u201d stwierdzaj\u0105c\u0105 niewa\u017cno\u015b\u0107 pozwolenia) b\u0119dzie wojewoda, a\u00a0organem drugiej instancji (organem rozpatruj\u0105cym ewentualne odwo\u0142anie niezadowolonej strony) Minister Rozwoju, za\u015b w\u00a0postepowaniu dotycz\u0105cym pozwolenia na u\u017cytkowanie organem pierwszej instancji b\u0119dzie wojew\u00f3dzki inspektor nadzoru budowlanego, a\u00a0organem drugiej instancji G\u0142\u00f3wny Inspektor Nadzoru Budowlanego. Decyzja organu pierwszej instancji nie wywo\u0142uje skutk\u00f3w prawnych, decyzja ta przed up\u0142ywem terminu do wniesienia odwo\u0142ania nie ulega wykonaniu, a\u00a0niesienie odwo\u0142ania w terminie wstrzymuje wykonanie decyzji.<\/p><p>W zwi\u0105zku z powy\u017cszym, w okresie pi\u0119ciu lat, o\u00a0kt\u00f3rym mowa w powy\u017cszej regulacji, decyzja (pozwolenie na budow\u0119 lub pozwolenie na u\u017cytkowanie) musi by\u0107 uniewa\u017cniona w obu instancjach, aby zosta\u0142a skutecznie wyeliminowana z obrotu prawnego. Aby skutecznie wyeliminowa\u0107 tak\u0105 decyzj\u0119 konieczne jest wydanie decyzji przez obie instancje (sekwencyjnie: decyzja pierwszej instancji \u2013 odwo\u0142anie \u2013 decyzja drugiej instancji) w\u00a0powy\u017cszym pi\u0119cioletnim okresie. Samo \u201ewyrobienie si\u0119\u201d z wydaniem decyzji niewa\u017cno\u015bciowej w tym terminie przez organ pierwszej instancji nie wystarcza do skutecznego wyeliminowania pozwolenia z obrotu prawnego (je\u017celi strona skorzysta z przys\u0142uguj\u0105cego jej prawa z\u0142o\u017cenia odwo\u0142ania).<\/p><p>Zagadnienie trwaj\u0105cej w niesko\u0144czono\u015b\u0107 niepewno\u015bci prawnej co do stabilno\u015bci i trwa\u0142o\u015bci decyzji administracyjnej, jako stanu dalece niepo\u017c\u0105danego, by\u0142o przedmiotem analizy w\u00a0wielu pracach naukowych i orzecznictwie, a\u00a0swoje zwie\u0144czenie znalaz\u0142o w prze\u0142omowy orzeczeniu Trybuna\u0142u Konstytucyjnego (wyrokiem z 12 maja 2015 r. wydany w sprawie o sygn. akt: P 46\/13 Trybuna\u0142 Konstytucyjny), w\u00a0kt\u00f3rym \u2013 upraszczaj\u0105c, Trybuna\u0142 Konstytucyjny stwierdzi\u0142 \u017ce, je\u017celi od wydania decyzji nast\u0105pi\u0142 znaczny up\u0142yw czasu, a decyzja by\u0142a podstaw\u0105 nabycia prawa, powinna by\u0107 wy\u0142\u0105czona dopuszczalno\u015b\u0107 stwierdzenia niewa\u017cno\u015bci decyzji, nawet je\u017celi by\u0142a ona wydana z ra\u017c\u0105cym naruszeniem prawa (nota bene Trybuna\u0142 Konstytucyjny zaleci\u0142 ustawodawcy zmian\u0119 przepis\u00f3w, czego niestety \u2013 poza omawian\u0105 tu zmian\u0105 w zakresie pozwole\u0144 na budow\u0119 i\u00a0u\u017cytkowanie &#8211; jeszcze nie uczyniono).<\/p><p>Trybuna\u0142 Konstytucyjny stwierdzi\u0142 ponadto, \u017ce mechanizmy uniewa\u017cniania ostatecznych decyzji powinny by\u0107 kompromisem pomi\u0119dzy zasad\u0105 trwa\u0142o\u015bci decyzji administracyjnych a zasad\u0105 praworz\u0105dno\u015bci. Zasada trwa\u0142o\u015bci ostatecznych decyzji administracyjnych stanowi gwarancj\u0119 pewno\u015bci i stabilno\u015bci obrotu prawnego. Uchylenie lub zmiana decyzji ostatecznych mo\u017ce nast\u0105pi\u0107 tylko w przypadkach przewidzianych i\u00a0\u015bci\u015ble okre\u015blonych przez przepisy prawa (bez mo\u017cliwo\u015bci stosowania tzw. wyk\u0142adni rozszerzaj\u0105cej). Zasada praworz\u0105dno\u015bci oznacza, \u017ce podejmowane przez organ administracji publicznej czynno\u015bci procesowe musz\u0105 znajdowa\u0107 swoje oparcie w powszechnie obowi\u0105zuj\u0105cych przepisach prawa. W \u017cyciu nie rzadko mamy do czynienia z kolizj\u0105 tych dw\u00f3ch zasad, z sytuacjami w kt\u00f3rych nie da si\u0119 ich w\u00a0spos\u00f3b pe\u0142ny pogodzi\u0107, a prawo powinno starannie wywa\u017ca\u0107 obie powy\u017csze zasady, a nie w spos\u00f3b bezwzgl\u0119dny przyznawa\u0107 prymat zasadzie praworz\u0105dno\u015bci (jak to ma nadal miejsce na gruncie KPA, ale na szcz\u0119\u015bcie ju\u017c nie w zakresie pozwole\u0144 na budow\u0119 i pozwole\u0144 na u\u017cytkowanie).<\/p><p>Obiekt, co do kt\u00f3rego wydano pozwolenie na budow\u0119, a pozwolenie sta\u0142o si\u0119 ostateczne, mo\u017ce by\u0107 eksploatowany na zasadzie zaufania do decyzji administracyjnych zgodnie z zasad\u0105 trwa\u0142o\u015bci decyzji administracyjnych, a\u00a0ewentualne zagro\u017cenia zwi\u0105zane z\u00a0nieprawid\u0142owo\u015bciami dotycz\u0105cymi decyzji ko\u0144cz\u0105 si\u0119 z up\u0142ywem pi\u0119ciu lat, a tak naprawd\u0119, w praktyce, bior\u0105c pod uwag\u0119 d\u0142ugi czas przeci\u0105gaj\u0105cych si\u0119 post\u0119powa\u0144 administracyjnych, du\u017co wcze\u015bniej. W praktyce, organ pierwszej instancji powinien wyda\u0107 decyzj\u0119 niewa\u017cno\u015bciow\u0105 w terminie czterech lat, aby umo\u017cliwi\u0107 przeprowadzenie i zako\u0144czenie post\u0119powania przed drug\u0105 instancj\u0105 przed up\u0142ywem okresu pi\u0119cioletniego. Je\u015bli decyzja organu pierwszej instancji nie zostanie wydana w terminie czterech lat, prawdopodobie\u0144stwo, \u017ce organ drugiej instancji zd\u0105\u017cy ze swoim rozstrzygni\u0119ciem jest w praktyce znikome.
