W rezultacie decyzje te mog\u0105 zosta\u0107 podwa\u017cone nawet po wielu latach od ich wydania. Brak trwa\u0142o\u015bci decyzji przek\u0142ada si\u0119 z kolei w ogromnym stopniu na niepewno\u015b\u0107 w zwi\u0105zku z realizacj\u0105 przedsi\u0119wzi\u0119\u0107 budowlanych, u\u017cytkowaniem obiekt\u00f3w lub sprzeda\u017c\u0105 nieruchomo\u015bci.<\/p><p>Postulaty zlikwidowania takiego stanu rzeczy i\u00a0wzmocnienia trwa\u0142o\u015bci decyzji by\u0142y zg\u0142aszane od lat, jednak ustawodawca uwzgl\u0119dni\u0142 je dopiero w nowelizacji prawa budowlanego, kt\u00f3ra wejdzie w \u017cycie z dniem 19 wrze\u015bnia 2020 r.<\/p><p>Zgodnie z nowelizacj\u0105, stwierdzenia niewa\u017cno\u015bci decyzji o pozwoleniu na budow\u0119 oraz o\u00a0pozwoleniu na u\u017cytkowanie b\u0119dzie mo\u017cna dokona\u0107 jedynie przez okres 5 lat. Okres ten w wypadku decyzji o pozwoleniu na budow\u0119 b\u0119dzie liczony od dnia dor\u0119czenia lub og\u0142oszenia decyzji, a w odniesieniu do decyzji o pozwoleniu na u\u017cytkowanie \u2013 od dnia, w kt\u00f3rym decyzja sta\u0142a si\u0119 ostateczna. Zmian\u0119 w og\u00f3lnym za\u0142o\u017ceniu nale\u017cy uzna\u0107 za jak najbardziej po\u017c\u0105dan\u0105 i wychodz\u0105c\u0105 naprzeciw oczekiwaniom rynku oraz zgodn\u0105 z kierunkiem wyznaczonym ju\u017c dawno przez orzecznictwo TK oraz z\u00a0podobnym pi\u0119cioletnim okresem na wznowienie post\u0119powania wynikaj\u0105cym z\u00a0Kodeksu Post\u0119powania administracyjnego.<\/p><p>Dalsze szczeg\u00f3\u0142y zwi\u0105zane z okre\u015bleniem, kt\u00f3re decyzje (bior\u0105c po uwag\u0119 czas ich wydania) zostan\u0105 obj\u0119te nowymi przepisami, nie zosta\u0142y opisane jednak zbyt precyzyjne. Podj\u0119ta przez nas pr\u00f3ba interpretacji przepis\u00f3w przej\u015bciowych reguluj\u0105cych ten temat prowadzi do wniosk\u00f3w, kt\u00f3re prezentujemy poni\u017cej. Zastrzegamy, \u017ce w\u00a0zwi\u0105zku z niejednoznaczno\u015bci\u0105 regulacji mog\u0105 pojawi\u0107 si\u0119 tak\u017ce inne stanowiska. Wskazanym jest, aby wadliwo\u015b\u0107 przepis\u00f3w zosta\u0142a wyeliminowana przez samego ustawodawc\u0119.<\/p><p>W przepisach przej\u015bciowych ustawodawca odni\u00f3s\u0142 si\u0119 naszym zdaniem do trzech przypadk\u00f3w, w kt\u00f3rych stosowane b\u0119d\u0105 przepisy dotychczasowe. Pierwszy z nich to sprawy wszcz\u0119te i niezako\u0144czone przed dniem wej\u015bcia w\u00a0\u017cycie nowelizacji. W potencjalnym post\u0119powaniu w sprawie stwierdzenia niewa\u017cno\u015bci pozwolenia na budow\u0119 wszcz\u0119tym i\u00a0niezako\u0144czonym przed 19 wrze\u015bnia 2020 r., pi\u0119cioletni okres wynikaj\u0105cy z nowych przepis\u00f3w nie b\u0119dzie mia\u0142 zastosowania.<\/p><p>Drugi przypadek obejmuje zamierzenia budowlane realizowane w oparciu o projekty budowlane sporz\u0105dzone na podstawie dotychczasowych przepis\u00f3w, w odniesieniu, do kt\u00f3rych wydano ostateczn\u0105 decyzj\u0119 o\u00a0pozwoleniu na budow\u0119 albo dokonano skutecznego zg\u0142oszenia przed dniem wej\u015bcia w\u00a0\u017cycie nowych przepis\u00f3w. Wydaje si\u0119, \u017ce chodzi tutaj wy\u0142\u0105cznie o inwestycje b\u0119d\u0105ce w\u00a0toku, nie za\u015b te ju\u017c zrealizowane.<br \/>Wreszcie trzeci przypadek to prowadzenie inwestycji w oparciu o projekt budowlany sporz\u0105dzony na dotychczasowych zasadach, kt\u00f3ry wyj\u0105tkowo w terminie 12 miesi\u0119cy od dnia wej\u015bcia w \u017cycie nowelizacji b\u0119dzie m\u00f3g\u0142 by\u0107 do\u0142\u0105czany do wniosku o wydanie pozwolenia na budow\u0119, zatwierdzenie projektu budowlanego lub zg\u0142oszenia budowy.<\/p><p>Pozosta\u0142e przypadki powinny podlega\u0107 bezpo\u015bredniemu dzia\u0142aniu nowej ustawy. Zaliczy\u0107 tutaj nale\u017cy decyzje wydane po 19 wrze\u015bnia 2020 r., kt\u00f3rych podstaw\u0119 stanowi\u0107 b\u0119d\u0105 projekty budowlane przygotowane wedle nowych rozwi\u0105za\u0144 prawnych. Do tej grupy zaliczone powinny by\u0107 tak\u017ce \u201estare\u201d decyzje wydane nawet wiele lat temu co do inwestycji zako\u0144czonych. We wszystkich tych przypadkach stwierdzenie niewa\u017cno\u015bci pozwole\u0144 na budow\u0119 lub pozwole\u0144 na u\u017cytkowanie po up\u0142ywie pi\u0119ciu lat nie b\u0119dzie mo\u017cliwe.<\/p><p>Sytuacja poszczeg\u00f3lnych inwestycji mo\u017ce by\u0107 zr\u00f3\u017cnicowana w kontek\u015bcie nowych regu\u0142 zapewniaj\u0105cych ochron\u0119 przed stwierdzeniem niewa\u017cno\u015bci decyzji dotycz\u0105cych tych\u017ce inwestycji.
