Projekt przewiduje m.in. prawo nabycia w\u0142asno\u015bci nieruchomo\u015bci gruntowej, wykorzystywanej na cele inne ni\u017c mieszkaniowe, przez jej u\u017cytkownika wieczystego.<br \/><br \/>Projekt jest kolejnym etapem zmian w ustawodawstwie, kt\u00f3re maj\u0105 doprowadzi\u0107 do wyeliminowania u\u017cytkowania wieczystego z polskiego porz\u0105dku prawnego. Uprzednio przyj\u0119to ustaw\u0119 z dnia 20 lipca 2018 r. o przekszta\u0142ceniu prawa u\u017cytkowania wieczystego grunt\u00f3w zabudowanych na cele mieszkaniowe w prawo w\u0142asno\u015bci tych grunt\u00f3w, kt\u00f3ra dokona\u0142a z mocy prawa przekszta\u0142cenia u\u017cytkowania wieczystego grunt\u00f3w zabudowanych na cele mieszkaniowe w prawo w\u0142asno\u015bci. Tym razem zmiany maj\u0105 dotyczy\u0107 grunt\u00f3w o innym przeznaczeniu ni\u017c mieszkaniowe oraz obj\u0105\u0107 swoim zasi\u0119giem szerszy zakres podmiot\u00f3w, w tym przedsi\u0119biorc\u00f3w.<\/p><p>Roszczenie o nabycie gruntu<br \/>W przeciwie\u0144stwie do poprzedniej ustawy z dnia 20\u00a0lipca 2018 r., u\u017cytkowanie wieczyste grunt\u00f3w innych ni\u017c przeznaczone na cele mieszkaniowe nie zostanie przekszta\u0142cone w prawo w\u0142asno\u015bci z mocy ustawy. Likwidacja prawa u\u017cytkowania wieczystego ma nast\u0105pi\u0107 w\u00a0drodze sprzeda\u017cy nieruchomo\u015bci na rzecz jej u\u017cytkownik\u00f3w wieczystych. Nowelizacja przyjmuje, \u017ce u\u017cytkownik wieczysty nieruchomo\u015bci gruntowej mo\u017ce wyst\u0105pi\u0107 z \u017c\u0105daniem sprzeda\u017cy tej nieruchomo\u015bci na jego rzecz. U\u017cytkownikowi wieczystemu b\u0119dzie wi\u0119c przys\u0142ugiwa\u0142o roszczenie o\u00a0nabycie nieruchomo\u015bci, z\u00a0kt\u00f3rego mo\u017ce skorzysta\u0107 wedle w\u0142asnej decyzji. Istotne, \u017ce skorzystanie z\u00a0roszczenia zostanie ograniczone w czasie do 12\u00a0miesi\u0119cy od dnia wej\u015bcia w \u017cycie nowych przepis\u00f3w. Organ nie mo\u017ce sprzeciwi\u0107 si\u0119 \u017c\u0105daniu i\u00a0b\u0119dzie zobowi\u0105zany do zawarcia umowy sprzeda\u017cy.<\/p><p>\u017b\u0105danie sprzeda\u017cy nie przys\u0142uguje, m.in.:<br \/>\u2022 je\u017celi nieruchomo\u015b\u0107 zosta\u0142a oddana w\u00a0u\u017cytkowanie wieczyste po dniu 31 grudnia 1997 r.;<br \/>\u2022 je\u017celi u\u017cytkownik wieczysty nie wykona\u0142 zobowi\u0105zania okre\u015blonego w umowie o oddanie nieruchomo\u015bci gruntowej w u\u017cytkowanie wieczyste;<br \/>\u2022 w odniesieniu do grunt\u00f3w po\u0142o\u017conych na terenie port\u00f3w i przystani morskich w rozumieniu ustawy z dnia 20 grudnia 1996 r. o portach i\u00a0przystaniach morskich;<br \/>\u2022 w odniesieniu do nieruchomo\u015bci gruntowej niezabudowanej.<br \/>Umowa sprzeda\u017cy nieruchomo\u015bci nie zostanie zawarta, je\u017celi toczy si\u0119 post\u0119powanie o rozwi\u0105zanie umowy o\u00a0oddanie tej nieruchomo\u015bci w u\u017cytkowanie wieczyste.<\/p><p>Cena sprzeda\u017cy<br \/>Nabycie nieruchomo\u015bci ma nast\u0105pi\u0107 za cen\u0119, kt\u00f3rej zasady wyliczenia zosta\u0142y okre\u015blone odr\u0119bnie dla nieruchomo\u015bci stanowi\u0105cych w\u0142asno\u015b\u0107 Skarbu Pa\u0144stwa i jednostek samorz\u0105du terytorialnego.<br \/>W odniesieniu do pierwszej kategorii nieruchomo\u015bci, cena ma by\u0107 ustalana jako 20-krotno\u015b\u0107 (w przypadku zap\u0142aty ceny jednorazowo) albo 25-krotno\u015b\u0107 (w\u00a0przypadku roz\u0142o\u017cenia ceny na raty) kwoty stanowi\u0105cej iloczyn dotychczasowej stawki procentowej op\u0142aty rocznej z tytu\u0142u u\u017cytkowania wieczystego oraz warto\u015bci nieruchomo\u015bci gruntowej okre\u015blonej na dzie\u0144 zawarcia umowy sprzeda\u017cy.<\/p><p>W odniesieniu do nieruchomo\u015bci stanowi\u0105cych w\u0142asno\u015b\u0107 jednostek samorz\u0105du terytorialnego, warunki sprzeda\u017cy okre\u015bl\u0105 samodzielnie rady albo sejmiki w drodze uchwa\u0142y albo zobowi\u0105\u017c\u0105 do indywidualnego okre\u015blania tych warunk\u00f3w organ wykonawczy. Cena nieruchomo\u015bci jednostek samorz\u0105du terytorialnego nie mo\u017ce by\u0107 wy\u017csza ni\u017c warto\u015b\u0107 nieruchomo\u015bci gruntowej. Rady i sejmiki zobowi\u0105zane b\u0119d\u0105 do podj\u0119cia uchwa\u0142 w terminie 4 miesi\u0119cy od wej\u015bcia w \u017cycie nowelizacji, a je\u015bli nie zdo\u0142aj\u0105 tego dokona\u0107 we wskazanym czasie, dla okre\u015blenia ceny nieruchomo\u015bci jednostek samorz\u0105du terytorialnego stosowane b\u0119d\u0105 regu\u0142y w\u0142a\u015bciwe dla nieruchomo\u015bci Skarbu Pa\u0144stwa.<\/p><p>Sprzeda\u017c a pomoc publiczna<br \/>Sprzeda\u017c nieruchomo\u015bci na rzecz u\u017cytkownik\u00f3w wieczystych b\u0119dzie nast\u0119powa\u0142a z uwzgl\u0119dnieniem przepis\u00f3w o pomocy publicznej, kt\u00f3re stosuje si\u0119 w\u00a0odniesieniu do przedsi\u0119biorc\u00f3w. U\u017cytkownicy wieczy\u015bci b\u0119d\u0105cy przedsi\u0119biorcami powinni poprzedzi\u0107 podj\u0119cie decyzji o\u00a0nabyciu nieruchomo\u015bci analiz\u0105 wskazuj\u0105c\u0105 czy nabycie to nast\u0105pi w re\u017cimie przepis\u00f3w o pomocy publicznej czy te\u017c poza nim. Nie chc\u0105c nara\u017ca\u0107 si\u0119 na konsekwencje zwi\u0105zane z\u00a0przekroczeniem dozwolonych limit\u00f3w pomocy publicznej, przedsi\u0119biorca powinien uwzgl\u0119dni\u0107 w\u00a0szczeg\u00f3lno\u015bci czynniki takie jak cena sprzeda\u017cy oraz warto\u015b\u0107 nieruchomo\u015bci, a ponadto kwoty dotychczas wykorzystane ze \u015brodk\u00f3w publicznych.<\/p><p>Zmiana ustawy ma wej\u015b\u0107 w \u017cycie w terminie 30 dni od dnia og\u0142oszenia.
