O\u00a0ile nie ma wi\u0119kszych w\u0105tpliwo\u015bci, \u017ce pozwolenie na budow\u0119 powinno odpowiada\u0107 okre\u015blonym w decyzji o\u00a0warunkach zabudowy parametrom, o tyle wiele w\u0105tpliwo\u015bci wi\u0105\u017ce si\u0119 z\u00a0tym, czy inwestor sk\u0142adaj\u0105c wniosek o\u00a0wydanie pozwolenia na budow\u0119 mo\u017ce \u201ewykroi\u0107\u201d z decyzji o warunkach zabudowy jedynie fragment inwestycji.<\/p><p>W doktrynie i orzecznictwie s\u0105d\u00f3w administracyjnych przewa\u017ca obecnie pogl\u0105d, \u017ce dzielenie jednej inwestycji przewidzianej w\u00a0decyzji o warunkach zabudowy jest niedopuszczalne. W\u00a0przesz\u0142o\u015bci jednak kwestia ta by\u0142a przedmiotem rozbie\u017cnych pogl\u0105d\u00f3w.<\/p><p>I tak, przyk\u0142adowo, w wyrokach Wojew\u00f3dzkiego Sadu Administracyjnego w Warszawie z dnia 11\u00a0grudnia 2009 r. (sygn. akt VII SA\/Wa 1569\/07) oraz z dnia 28 lutego 2012 r. (sygn. akt VII SA\/Wa 2210\/11) stwierdzono, \u017ce z\u0142o\u017cenie wniosku o\u00a0wydanie pozwolenia na budow\u0119 na teren mniejszy ni\u017c okre\u015blony w\u00a0decyzji o warunkach zabudowy jest dopuszczalne. Takiemu bowiem wnioskowi nie mo\u017cna postawi\u0107 zarzutu naruszenia art. 35 ust.\u00a01 prawa budowlanego, gdy\u017c nie wyst\u0105pi sprzeczno\u015b\u0107 mi\u0119dzy decyzj\u0105 o warunkach zabudowy a pozwoleniem na budow\u0119 wydanym zgodnie z takim wnioskiem. Zgodnie z przyj\u0119tym w\u00a0powy\u017cszych wyrokach pogl\u0105dem inwestor m\u00f3g\u0142 samodzielnie okre\u015bli\u0107 zakres terytorialny projektu budowlanego pod warunkiem, \u017ce mie\u015bci\u0142 si\u0119 on w\u00a0granicach okre\u015blonych w decyzji o warunkach zabudowy. O\u015bwiadczenie o prawie do dysponowania gruntem na cele budowlane zobowi\u0105zany by\u0142 z\u0142o\u017cy\u0107 wy\u0142\u0105cznie w odniesieniu do terenu obj\u0119tego wnioskiem.<\/p><p>Stanowisko to podda\u0142 gruntownej krytyce Naczelny S\u0105d Administracyjny w wyroku z dnia 14 listopada 2013 r. (sygn. akt II OSK 1340\/12). S\u0105d wyszed\u0142 z\u00a0za\u0142o\u017cenia, \u017ce decyzja o\u00a0warunkach zabudowy przes\u0105dza o ewentualnej dopuszczalno\u015bci realizacji okre\u015blonego przedsi\u0119wzi\u0119cia stanowi\u0105cego ca\u0142o\u015b\u0107 w\u00a0sensie urbanistycznym, za\u015b mo\u017cliwo\u015b\u0107 jego podzielenia dotyczy tylko etapu realizacyjnego. Warunki okre\u015blone w decyzji o warunkach zabudowy dotycz\u0105 ca\u0142ego zamierzenia budowlanego w\u00a0powi\u0105zaniu z okoliczn\u0105 zabudow\u0105, a nie wy\u0142\u0105cznie jego okre\u015blonych element\u00f3w. W\u00a0szczeg\u00f3lno\u015bci dotyczy to rozwi\u0105za\u0144 komunikacyjnych i infrastrukturalnych. Zdaniem S\u0105du istnieje w tym przypadku podobie\u0144stwo do przepis\u00f3w reguluj\u0105cych dokonywanie ocen oddzia\u0142ywania przedsi\u0119wzi\u0119\u0107 na \u015brodowisko, przy kt\u00f3rych dzielenie ich na mniejsze segmenty nie zmienia ich kwalifikacji jako jednego zamierzenia.<\/p><p>Naczelny S\u0105d Administracyjny stan\u0105\u0142 na stanowisku, \u017ce obowi\u0105zek to\u017csamo\u015bci terytorialnej zamierzenia budowlanego przewidzianego w\u00a0decyzji o warunkach zabudowy oraz w\u00a0pozwoleniu na budow\u0119 wynika z art. 55 ustawy z\u00a0dnia 27 marca 2003 r. o\u00a0planowaniu i\u00a0zagospodarowaniu przestrzennym w zw. z art. 64 tej ustawy, zgodnie z kt\u00f3rymi decyzja o warunkach zabudowy wi\u0105\u017ce organ wydaj\u0105cy decyzj\u0119 o\u00a0pozwoleniu na budow\u0119. Zwi\u0105zanie organu administracji architektoniczno-budowlanej dotyczy wszystkich warunk\u00f3w rozstrzygni\u0119cia planistycznego. Zatem organ ten nie mo\u017ce post\u0119powa\u0107 wbrew jakimkolwiek wymogom wynikaj\u0105cym z decyzji ustalaj\u0105cej warunki zabudowy. S\u0105d stwierdzi\u0142, \u017ce \u201eakceptacja pogl\u0105du przeciwnego oznacza\u0142aby dopuszczenie mo\u017cliwo\u015bci swobodnej oceny przez organ architektoniczno-budowlany wybranych przez inwestora element\u00f3w, kt\u00f3re m\u00f3g\u0142by obj\u0105\u0107 wnioskiem, realizuj\u0105c tylko niekt\u00f3re z warunk\u00f3w zamieszczonych w decyzji o\u00a0warunkach zabudowy zwi\u0105zanych bezpo\u015brednio w\u00a0wybranym fragmentem zamierzenia, a\u00a0pomijaj\u0105c inne warunki jako nieobj\u0119te wnioskiem o wydanie pozwolenia na budow\u0119, co przeczy\u0142oby zasadzie wyra\u017conej w art. 55 ustawy o planowaniu i\u00a0zagospodarowaniu przestrzennym\u201d.<\/p><p>W\u00a0konsekwencji zakres projektu zagospodarowania terenu okre\u015blony we wniosku o wydanie pozwolenia na budow\u0119 winien pokrywa\u0107 si\u0119 z\u00a0liniami rozgraniczaj\u0105cymi okre\u015blonymi w\u00a0za\u0142\u0105czniku graficznym do decyzji o warunkach zabudowy. Oznacza to, \u017ce na terenach nieobj\u0119tych miejscowymi planami zagospodarowania przestrzennego inwestor ma tylko wzgl\u0119dn\u0105 swobod\u0119 okre\u015blania zakresu realizowanej przez siebie inwestycji. Jest bowiem zwi\u0105zany ustaleniami wydanej na sw\u00f3j wniosek decyzji o\u00a0warunkach zabudowy, kt\u00f3ra przes\u0105dza o\u00a0zakresie terytorialnym sk\u0142adanego wniosku o\u00a0wydanie pozwolenia na budow\u0119.<\/p><p>Nie stoi to na przeszkodzie realizacji takiej wieloelementowej inwestycji w etapach. W\u00a0takiej sytuacji znajduje zastosowanie art. 33 ust. 1 prawa budowlanego, zgodnie z kt\u00f3rym w\u00a0przypadku zamierzenia budowlanego obejmuj\u0105cego wi\u0119cej ni\u017c jeden obiekt, pozwolenie na budow\u0119 mo\u017ce, na wniosek inwestora, dotyczy\u0107 wybranych obiekt\u00f3w lub zespo\u0142u obiekt\u00f3w, mog\u0105cych samodzielnie funkcjonowa\u0107 zgodnie z\u00a0przeznaczeniem. W\u00a0takiej sytuacji inwestor jest obowi\u0105zany przedstawi\u0107 projekt zagospodarowania dzia\u0142ki lub terenu, dla ca\u0142ego zamierzenia budowlanego. Zdaniem Naczelnego S\u0105du Administracyjnego ze wzgl\u0119du na tre\u015b\u0107\u00a0art. 32 ust. 2 pkt 2\u00a0prawa budowlanego inwestor jest jednak\u017ce zobowi\u0105zany do z\u0142o\u017cenia o\u015bwiadczenia o\u00a0posiadanym prawie do dysponowania na cele budowlane ca\u0142\u0105 nieruchomo\u015bci\u0105 po\u0142o\u017con\u0105 na terenie obj\u0119tym wnioskiem, a zatem w\u00a0przypadku realizacji inwestycji wieloetapowej o\u015bwiadczenie takie (dotycz\u0105ce ca\u0142ego przedsi\u0119wzi\u0119cia) powinno by\u0107 z\u0142o\u017cone ju\u017c przy zatwierdzaniu projektu budowlanego dla pierwszego etapu. Takie rozwi\u0105zanie uprawdopodabnia, \u017ce zamierzenie budowlane w\u00a0kszta\u0142cie przedstawionym w decyzji o\u00a0warunkach zabudowy b\u0119dzie mog\u0142o zosta\u0107 zrealizowane, gdy\u017c \u201estwarza [ono &#8211; TM] realne podstawy do uzyskania pozwole\u0144 na budow\u0119 dla pozosta\u0142ych obiekt\u00f3w planowanych do realizacji w nast\u0119pnych etapach\u201d. W przeciwnym wypadku nie by\u0142oby jakichkolwiek gwarancji, \u017ce inwestor w\u00a0przysz\u0142o\u015bci b\u0119dzie realizowa\u0142 inne obiekty przewidziane decyzj\u0105 o warunkach zabudowy.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a37fa13 elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"a37fa13\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
