Wsp\u00f3\u0142w\u0142asno\u015b\u0107 charakteryzuj\u0105 trzy podstawowe cechy, tj. jedno\u015b\u0107 przedmiotu, wielo\u015b\u0107 podmiot\u00f3w, kt\u00f3rym przys\u0142uguje prawo wsp\u00f3\u0142w\u0142asno\u015bci oraz niepodzielno\u015b\u0107 wsp\u00f3lnego prawa, kt\u00f3ra polega na tym, i\u017c ka\u017cdy ze wsp\u00f3\u0142w\u0142a\u015bcicieli ma prawo do ca\u0142ej nieruchomo\u015bci.Takie wsp\u00f3lne prawo do rzeczy bez jej fizycznego wyodr\u0119bnienia, rodzi jednak w\u00a0praktyce sporo problem\u00f3w.<\/p><p>Zgodnie z art. 206 kodeksu cywilnego, ka\u017cdy ze wsp\u00f3\u0142w\u0142a\u015bcicieli jest uprawniony do wsp\u00f3\u0142posiadania rzeczy wsp\u00f3lnej oraz do korzystania z niej w takim zakresie, jaki daje si\u0119 pogodzi\u0107 ze wsp\u00f3\u0142posiadaniem i korzystaniem z\u00a0rzeczy przez pozosta\u0142ych wsp\u00f3\u0142w\u0142a\u015bcicieli. Je\u017celi wi\u0119c jeden ze wsp\u00f3\u0142w\u0142a\u015bcicieli korzysta z\u00a0nieruchomo\u015bci w spos\u00f3b z tym sprzeczny, pozosta\u0142ym wsp\u00f3\u0142w\u0142a\u015bcicielom przys\u0142uguje szereg uprawnie\u0144.<br \/>Warto najpierw zaznaczy\u0107, i\u017c wsp\u00f3\u0142w\u0142a\u015bcicielowi pozbawionemu uprawnie\u0144 przewidzianych w art. 206 kodeksu cywilnego przys\u0142uguje roszczenie o\u00a0dopuszczenie do wsp\u00f3\u0142posiadania i\u00a0korzystania. Roszczenie to mo\u017ce by\u0107 skierowane zar\u00f3wno przeciwko osobie trzeciej, jak te\u017c przeciwko wsp\u00f3\u0142w\u0142a\u015bcicielowi, je\u017celi zaw\u0142adn\u0105\u0142 rzecz\u0105 i uniemo\u017cliwia korzystanie i\u00a0posiadanie innemu wsp\u00f3\u0142w\u0142a\u015bcicielowi. Takie roszczenie nie przys\u0142uguje jednak w sytuacji, np. gdy wsp\u00f3\u0142w\u0142a\u015bciciele zawarli porozumienie okre\u015blaj\u0105ce inny od ustawowego spos\u00f3b korzystania z rzeczy wsp\u00f3lnej albo gdy zosta\u0142o wydane w tym przedmiocie orzeczenie s\u0105du czy gdy jeden ze wsp\u00f3\u0142w\u0142a\u015bcicieli zrezygnuje z\u00a0wykonywania tego uprawnienia na rzecz innych wsp\u00f3\u0142w\u0142a\u015bcicieli.<\/p><p>Realizacja roszczenia o dopuszczenie do wsp\u00f3\u0142posiadania mo\u017ce nast\u0105pi\u0107 mi\u0119dzy innymi przez podzia\u0142 nieruchomo\u015bci wsp\u00f3lnej. Zgodnie z\u00a0uchwa\u0142\u0105 S\u0105du Najwy\u017cszego z dnia 13 marca 2008 r., sygn.\u00a0III CZP 3\/08 wsp\u00f3\u0142w\u0142a\u015bciciele mog\u0105 ustali\u0107 regu\u0142y korzystania z rzeczy wsp\u00f3lnej, w tym celu mog\u0105 zawrze\u0107 umow\u0119 o podzia\u0142 rzeczy tzw. \u00a0quoad usum, sprowadzaj\u0105c\u0105 si\u0119 do wyodr\u0119bnienia poszczeg\u00f3lnych cz\u0119\u015bci rzeczy wsp\u00f3lnej i przeznaczenia ich do wy\u0142\u0105cznego korzystania przez okre\u015blonych wsp\u00f3\u0142w\u0142a\u015bcicieli. \u00a0Warto jednak pami\u0119ta\u0107, \u017ce podzia\u0142 rzeczy wsp\u00f3lnej do korzystania\u00a0nie jest definitywny, w zale\u017cno\u015bci bowiem od zmieniaj\u0105cych si\u0119 okoliczno\u015bci mo\u017ce on ulec stosownej modyfikacji, np. na skutek porozumienia wsp\u00f3\u0142w\u0142a\u015bcicieli, b\u0105d\u017a te\u017c orzeczenia s\u0105dowego.<\/p><p>Dodatkowo, w\u0142a\u015bciciel ma r\u00f3wnie\u017c mo\u017cliwo\u015b\u0107 \u017c\u0105dania wydania po\u017cytk\u00f3w oraz przychod\u00f3w z\u00a0rzeczy wsp\u00f3lnej oraz mo\u017ce \u017c\u0105da\u0107 wynagrodzenia za bezprawne korzystanie z\u00a0rzeczy wsp\u00f3lnej<br \/>Zgodnie z uchwa\u0142\u0105 S\u0105dy Najwy\u017cszego z\u00a019 marca 2013 r., sygn. III CZP 88\/12, wsp\u00f3\u0142w\u0142a\u015bciciel mo\u017ce domaga\u0107 si\u0119 od pozosta\u0142ych wsp\u00f3\u0142w\u0142a\u015bcicieli, korzystaj\u0105cych z rzeczy wsp\u00f3lnej z naruszeniem art. 206 kodeksu cywilnego w spos\u00f3b wy\u0142\u0105czaj\u0105cy jego wsp\u00f3\u0142posiadanie, wynagrodzenia za korzystanie z tej rzeczy na podstawie art. 224 \u00a7 2 lub art. 225 kodeksu cywilnego. Z roszczenia o\u00a0wynagrodzenie za bezprawne korzystanie z\u00a0nieruchomo\u015bci w\u0142a\u015bciciel mo\u017ce skorzysta\u0107 tak\u017ce wtedy, gdy z powodu pozbawienia go wsp\u00f3\u0142posiadania dosz\u0142o do s\u0105dowego podzia\u0142u\u00a0quoad usum\u00a0lub wszcz\u0119te zosta\u0142o post\u0119powanie o zniesienie wsp\u00f3\u0142w\u0142asno\u015bci. Roszczenie to ma cz\u0119\u015bciowo charakter odszkodowawczy \u2013 mo\u017ce zmierza\u0107 do zwr\u00f3cenia koszt\u00f3w poniesionych przez w\u0142a\u015bciciela zmuszonego do korzystania z cudzej rzeczy czy do uzyskania kompensaty za utracone korzy\u015bci (np. w zwi\u0105zku z niemo\u017cno\u015bci\u0105 wynaj\u0119cia rzeczy), a cz\u0119\u015bciowo przypomina roszczenie o\u00a0zwrot bezpodstawnego wzbogacenia. Warto jednak mie\u0107 na uwadze, i\u017c o wysoko\u015bci nale\u017cnego wynagrodzenia decyduj\u0105 stawki rynkowe oraz czas posiadania przez nieuprawnionego. Nie ma natomiast znaczenia czy posiadacz w rzeczywisto\u015bci odni\u00f3s\u0142 jakie\u015b korzy\u015bci, a w\u0142a\u015bciciel poni\u00f3s\u0142 jaki\u015b uszczerbek (por. wyrok S\u0105du Najwy\u017cszego z 15 kwietnia 2004 r., sygn. IV CK 273\/03). Roszczenie wsp\u00f3\u0142w\u0142a\u015bciciela o wynagrodzenie za bezprawne korzystanie z rzeczy wsp\u00f3lnej mo\u017ce by\u0107 dochodzone zar\u00f3wno samodzielnie, jak i obok roszczenia o zwrot po\u017cytk\u00f3w. Wsp\u00f3\u0142w\u0142a\u015bciciel mo\u017ce te\u017c dochodzi\u0107 dopuszczenia do wsp\u00f3\u0142posiadania, jak r\u00f3wnie\u017c wynagrodzenia za bezprawne korzystanie z rzeczy przez innych wsp\u00f3\u0142w\u0142a\u015bcicieli. Takie roszczenie ma samodzielny charakter.<\/p><p>Niezale\u017cnie od powy\u017cszego, wsp\u00f3\u0142w\u0142a\u015bciciel pozbawiony przez innego wsp\u00f3\u0142w\u0142a\u015bciciela posiadania rzeczy wsp\u00f3lnej mo\u017ce zawsze wyst\u0105pi\u0107 o zniesienie wsp\u00f3\u0142w\u0142asno\u015bci. Ma to miejsce zar\u00f3wno w\u00f3wczas, gdy wsp\u00f3\u0142w\u0142a\u015bciciele wsp\u00f3\u0142dzia\u0142aj\u0105 przy wykonywaniu uprawnie\u0144 do wsp\u00f3lnej rzeczy, jak i wtedy, gdy brak jest zgody pomi\u0119dzy nimi.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b29ac22 elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"b29ac22\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
