Dzieje si\u0119 tak dlatego, \u017ce dopiero 31\u00a0grudnia 2020 roku up\u0142yn\u0105\u0142 termin obowi\u0105zywania okresu przej\u015bciowego przewidzianego w umowie o wyst\u0105pieniu Zjednoczonego Kr\u00f3lestwa Wielkiej Brytanii i\u00a0Irlandii P\u00f3\u0142nocnej z Unii Europejskiej (Dz. Urz. UE 2019\/C 384 I\/01). Zgodnie z artyku\u0142em 126 tej umowy z dniem jej wej\u015bcia w \u017cycie tj. 1 lutego 2020 roku rozpocz\u0105\u0142 si\u0119 okres przej\u015bciowy zwany te\u017c okresem wdra\u017cania, kt\u00f3ry up\u0142yn\u0105\u0142 jednak w\u00a0dniu 31 grudnia 2020 r. W okresie tym, co do zasady status prawny podmiot\u00f3w brytyjskich w\u00a0obr\u0119bie jednolitego rynku nie uleg\u0142 zmianie. W\u00a0\u015bwietle prawa polskiego, o zachowaniu dotychczasowego statusu podmiot\u00f3w brytyjskich w okresie przej\u015bciowym rozstrzygni\u0119to ustaw\u0105 z\u00a0dnia 19 lipca 2019 r. o okresie przej\u015bciowym, o\u00a0kt\u00f3rym mowa w Umowie o wyst\u0105pieniu Zjednoczonego Kr\u00f3lestwa Wielkiej Brytanii i\u00a0Irlandii P\u00f3\u0142nocnej z Unii Europejskiej i\u00a0Europejskiej Wsp\u00f3lnoty Energii Atomowej (Dz.U. 2019 poz. 1516). Na mocy tej ustawy ilekro\u0107 w\u00a0przepisach odr\u0119bnych jest mowa o pa\u0144stwie cz\u0142onkowskim Unii Europejskiej lub Europejskiej Wsp\u00f3lnoty Energii Atomowej, to w okresie przej\u015bciowym, nale\u017ca\u0142o pod tym poj\u0119ciem rozumie\u0107 r\u00f3wnie\u017c Zjednoczone Kr\u00f3lestwo Wielkiej Brytanii i Irlandii P\u00f3\u0142nocnej. Z up\u0142ywem wskazanego okresu przej\u015bciowego skutki brexitu zaczynaj\u0105 wyst\u0119powa\u0107 w ca\u0142ej pe\u0142ni, cho\u0107 oczywi\u015bcie nie wszystkie b\u0119d\u0105 odczuwane natychmiast. Niekt\u00f3re z nich s\u0105 jednak do\u015b\u0107 oczywiste i dotycz\u0105 tego czym zajmujemy si\u0119 na co dzie\u0144.<\/p><p>Jednym z nich, istotnym dla polskiego rynku nieruchomo\u015bci jest wy\u0142\u0105czenie stosowania do obywateli i sp\u00f3\u0142ek brytyjskich przepisu art. 8 ust. 2 ustawy o nabywaniu nieruchomo\u015bci przez cudzoziemc\u00f3w wprowadzaj\u0105cego generalne zwolnienie z obowi\u0105zku uzyskania zezwolenia na nabycie nieruchomo\u015bci po\u0142o\u017conej w Polsce przez cudzoziemc\u00f3w, b\u0119d\u0105cych obywatelami lub przedsi\u0119biorcami pa\u0144stw cz\u0142onkowskich Europejskiego Obszaru Gospodarczego obejmuj\u0105cego wszystkie pa\u0144stwa cz\u0142onkowskie Unii Europejskiej. W konsekwencji opuszczenia przez Wielk\u0105 Brytani\u0119 Unii Europejskiej jej obywatele, podobnie jak brytyjskie osoby prawne b\u0119d\u0105 musieli uzyska\u0107 zezwolenie ministra w\u0142a\u015bciwego do spraw wewn\u0119trznych na nabycie nieruchomo\u015bci. Wyj\u0105tki od tej zasady obejmuj\u0105 niezbyt istotne z punktu funkcjonowania rynku nieruchomo\u015bci przypadki wymienione w art. 8\u00a0ust. 1 ustawy o nabywaniu nieruchomo\u015bci przez cudzoziemc\u00f3w. Tym samym sytuacja prawna obywateli i inwestor\u00f3w brytyjskich w zakresie prawa do nabywania nieruchomo\u015bci w Polsce zosta\u0142a zr\u00f3wnana z sytuacj\u0105 podmiot\u00f3w nieb\u0119d\u0105cych obywatelami lub przedsi\u0119biorcami pa\u0144stw cz\u0142onkowskich Unii Europejskiej.<\/p><p>W konsekwencji wobec podmiot\u00f3w z Wielkiej Brytanii zastosowanie znajdzie przepis art. 1 ust. 1 ustawy z dnia 24 marca 1920 roku o nabywaniu nieruchomo\u015bci przez cudzoziemc\u00f3w, zgodnie z\u00a0kt\u00f3rym nabycie nieruchomo\u015bci przez cudzoziemca wymaga zezwolenia, kt\u00f3re jest wydawane w drodze decyzji administracyjnej, przez ministra w\u0142a\u015bciwego do spraw wewn\u0119trznych, je\u017celi sprzeciwu nie wniesie Minister Obrony Narodowej, a w przypadku nieruchomo\u015bci rolnych, je\u017celi sprzeciwu r\u00f3wnie\u017c nie wniesie minister w\u0142a\u015bciwy do spraw rozwoju wsi.<\/p><p>Niestety zatem, w nowej pobrexitowej rzeczywisto\u015bci, inwestorzy nieruchomo\u015bciowi z\u00a0Wielkiej Brytanii znale\u017ali si\u0119 w sytuacji formalnej podobnej do tej, w kt\u00f3rej znajdowali si\u0119 przed 1 maja 2004 roku. Podobnej lecz nie identycznej, bo nale\u017cy pami\u0119ta\u0107, \u017ce r\u00f3wnie\u017c w\u00a0okresie przedakcesyjnym nabywcy nieruchomo\u015bci po\u0142o\u017conych w Polsce pochodz\u0105cy z pa\u0144stw cz\u0142onkowskich Unii Europejskiej, a\u00a0wcze\u015bniej Wsp\u00f3lnot Europejskich mogli liczy\u0107 na preferencyjne traktowanie na mocy art. 44 uk\u0142adu stowarzyszeniowego z 16 grudnia 1991 roku (Uk\u0142ad Europejski ustanawiaj\u0105cy stowarzyszenie mi\u0119dzy Rzecz\u0105pospolit\u0105 Polsk\u0105 a\u00a0Wsp\u00f3lnotami Europejskimi i ich Pa\u0144stwami Cz\u0142onkowskimi). W chwili obecnej relacje handlowe pomi\u0119dzy Uni\u0105 Europejsk\u0105 z\u00a0Zjednoczonym Kr\u00f3lestwem reguluje natomiast umowa Umowa o handlu i wsp\u00f3\u0142pracy mi\u0119dzy UE a Wielk\u0105 Brytani\u0105 (The EU-UK Trade and Cooperation Agreement).<\/p><p>Trudno jest w tej chwili orzec jaka b\u0119dzie praktyka MSWiA w zakresie wydawania tych zezwole\u0144. Odwo\u0142uj\u0105c si\u0119 do do\u015bwiadcze\u0144 zwi\u0105zanych z uzyskiwaniem zezwole\u0144 przez inwestor\u00f3w brytyjskich w okresie sprzed wej\u015bcia Polski do Unii Europejskiej mo\u017cna zapewne spodziewa\u0107 si\u0119, \u017ce co do zasady uzyskanie tego typu zezwolenia b\u0119dzie raczej formalno\u015bci\u0105. Z\u00a0drugiej strony jednak jest to formalno\u015b\u0107 czasoch\u0142onna i przez to w spos\u00f3b istotny utrudniaj\u0105ca przeprowadzenie transakcji, a zatem b\u0119dzie mia\u0142o negatywny skutek dla funkcjonowania rynku.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e936512 elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"e936512\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
