Dotyczy to r\u00f3wnie\u017c sytuacji nieruchomo\u015bci, kt\u00f3rej podzia\u0142 zosta\u0142 dokonany na wniosek u\u017cytkownika wieczystego, z tym \u017ce prawo u\u017cytkowania wieczystego dzia\u0142ek gruntu wydzielonych pod drogi publiczne wygasa z\u00a0dniem, w\u00a0kt\u00f3rym decyzja zatwierdzaj\u0105ca podzia\u0142 sta\u0142a si\u0119 ostateczna albo orzeczenie o\u00a0podziale prawomocne.<\/p><p>Istotn\u0105 kwesti\u0105 jest fakt, i\u017c powy\u017cej opisane odebranie prawa w\u0142asno\u015bci i prawa u\u017cytkowania wieczystego z mocy prawa mo\u017ce nast\u0105pi\u0107 jedynie za odszkodowaniem, a zgodnie z konstytucyjn\u0105 zasad\u0105 dopuszczalno\u015bci wyw\u0142aszczenia \u2013 jedynie za s\u0142usznym odszkodowaniem. Przedmiotem uzgodnie\u0144 powinny by\u0107 wysoko\u015b\u0107, forma i termin realizacji uprawnienia odszkodowawczego. Wysoko\u015b\u0107 odszkodowania ustalana jest na podstawie stanu nieruchomo\u015bci wyw\u0142aszczonej, ale tak\u017ce na podstawie przeznaczenia i jej warto\u015bci w dniu wydania decyzji o wyw\u0142aszczeniu. Przy okre\u015bleniu warto\u015bci nieruchomo\u015bci powinno si\u0119 zwr\u00f3ci\u0107 uwag\u0119 na jej rodzaj, po\u0142o\u017cenie, spos\u00f3b u\u017cytkowania oraz oczywi\u015bcie aktualne ceny na rynku nieruchomo\u015bci. Przepisy ustawy o gospodarce nieruchomo\u015bciami nie reguluj\u0105 szczeg\u00f3\u0142owo przeprowadzania uzgodnie\u0144 &#8211; proces ten, sprowadzaj\u0105cy si\u0119 do wypracowania przez zainteresowane strony, w drodze negocjacji, warunk\u00f3w na jakich gotowe s\u0105 one zawrze\u0107 satysfakcjonuj\u0105c\u0105 je umow\u0119 w sprawie wysoko\u015bci odszkodowania, jest pozostawiony woli stron.<\/p><p>Naczelny S\u0105d Admninistracyjny w wyroku z dnia 17 wrze\u015bnia 2014 roku (I OSK 2102\/14) orzek\u0142, \u017ce je\u017celi na wniosek o uzgodnienie odszkodowania organ nie reaguje w rozs\u0105dnym czasie b\u0105d\u017a informuje o braku \u015brodk\u00f3w finansowych, kt\u00f3re pozwala\u0142yby mu podj\u0105\u0107 negocjacje (uzgodnienia) w danym roku, to tym samym ziszcza si\u0119 przes\u0142anka nie doj\u015bcia do uzgodnienia, co z kolei stanowi przes\u0142ank\u0119 do wszcz\u0119cia przez starost\u0119 post\u0119powania o\u00a0ustalenie odszkodowania na zasadach i w trybie post\u0119powania o wyw\u0142aszczenie. Wniosek do starosty w sprawie ustalenia wysoko\u015bci odszkodowania sk\u0142ada by\u0142y w\u0142a\u015bciciel lub by\u0142y u\u017cytkownik wieczysty.<\/p><p>Zap\u0142ata odszkodowania nast\u0119puje jednorazowo w\u00a0terminie 14 dni od dnia, w kt\u00f3rym decyzja o\u00a0wyw\u0142aszczeniu podlega wykonaniu albo decyzja o odszkodowaniu sta\u0142a si\u0119 ostateczna. W\u00a0przypadku wydania decyzji o niezw\u0142ocznym zaj\u0119ciu nieruchomo\u015bci, na wniosek osoby wyw\u0142aszczanej, wyp\u0142aca si\u0119 zaliczk\u0119 w wysoko\u015bci 70% odszkodowania ustalonego przez organ pierwszej instancji w decyzji o wyw\u0142aszczeniu. Wysoko\u015b\u0107 odszkodowania za wyw\u0142aszczone nieruchomo\u015bci pomniejsza si\u0119 o\u00a0kwot\u0119 wyp\u0142aconej zaliczki.<\/p><p>Wspomnie\u0107 nale\u017cy, i\u017c zgodnie z art. 131 ustawy o\u00a0gospodarce nieruchomo\u015bciami w ramach odszkodowania w\u0142a\u015bcicielowi lub u\u017cytkownikowi wieczystemu wyw\u0142aszczonej nieruchomo\u015bci mo\u017ce by\u0107 przyznana, za jego zgod\u0105, r\u00f3wnie\u017c odpowiednia nieruchomo\u015b\u0107 zamienna. Nieruchomo\u015b\u0107 zamienn\u0105 przyznaje si\u0119 z zasobu nieruchomo\u015bci Skarbu Pa\u0144stwa, je\u017celi wyw\u0142aszczenie nast\u0119puje na rzecz Skarbu Pa\u0144stwa lub z zasobu nieruchomo\u015bci odpowiedniej jednostki samorz\u0105du terytorialnego, je\u017celi wyw\u0142aszczenie nast\u0119puje na rzecz tej jednostki.<\/p><p>Warto zaznaczy\u0107 r\u00f3wnie\u017c, \u017ce \u017c\u0105danie ustalenia i\u00a0wyp\u0142aty odszkodowania nie ulega przedawnieniu, chyba, ze zosta\u0142o to wyra\u017anie okre\u015blone przez ustawodawc\u0119 w przepisie szczeg\u00f3lnym. Naczelny S\u0105d Administracyjny w\u00a0wyroku z 20 listopada 2008 roku (I OSK 1588\/07) jasno stwierdzi\u0142, \u017ce skoro roszczenie o\u00a0zap\u0142at\u0119 odszkodowania powsta\u0142o na gruncie stosunku administracyjnego, to jego realizacja wraz z ocen\u0105 wszystkich skutk\u00f3w prawnych \u2013 w\u00a0tym r\u00f3wnie\u017c przedawnienia \u2013 winna by\u0107 oceniana na podstawie przepis\u00f3w materialnych prawa administracyjnego. Na gruncie prawa administracyjnego o przedawnieniu roszczenia mo\u017cna m\u00f3wi\u0107 jedynie w\u00f3wczas, gdy przepis prawa wyra\u017anie tak stanowi.
