Z uwagi na konieczno\u015b\u0107 dostosowania prawa krajowego do przepis\u00f3w Rozporz\u0105dzenia, polski ustawodawca pracuje nad projektem ustawy \u2013 Przepisy wprowadzaj\u0105ce ustaw\u0119 o ochronie danych osobowych (dalej jako \u201eProjekt\u201d) \u2013 kt\u00f3re przewiduj\u0105 dokonanie licznych zmian w wielu aktach prawnych, m.in. w kodeksie pracy. Projekt opracowywany jest przez Ministerstwo Cyfryzacji, obecnie na etapie opiniowania, przed ko\u0144cem bie\u017c\u0105cego roku przewiduje si\u0119 jego przyj\u0119cie przez Rad\u0119 Ministr\u00f3w. Poni\u017cej przedstawiamy zarys obecnie planowanych w Projekcie rozwi\u0105za\u0144 w zakresie przetwarzania danych osobowych pracownik\u00f3w przez pracodawc\u00f3w z zaznaczeniem, \u017ce do czasu uchwalenia ustawy mog\u0105 one ulec zmianie.<\/p><p>Projekt zak\u0142ada w szczeg\u00f3lno\u015bci dostosowanie brzmienia obowi\u0105zuj\u0105cych przepis\u00f3w prawa pracy do wymogu zawartego w art. 6 ust. 1 lit. c Rozporz\u0105dzenia, wprowadzaj\u0105cego przes\u0142ank\u0119 istnienia obowi\u0105zku prawnego jako podstawy pobierania danych osobowych. W konsekwencji przepisy, kt\u00f3re obecnie zawieraj\u0105 jedynie uprawnienie pracodawcy \u017c\u0105dania okre\u015blonych danych osobowych w kwestiach zwi\u0105zanych ze stosunkiem pracy, zostan\u0105 zmienione na obowi\u0105zek pobierania tych danych. Projekt przewiduje r\u00f3wnie\u017c modyfikacj\u0119 dotychczasowego katalogu danych osobowych pobieranych od kandydat\u00f3w do pracy lub pracownik\u00f3w, uwzgl\u0119dniaj\u0105c\u0105 ich niezb\u0119dno\u015b\u0107 dla pracodawcy, obligatoryjno\u015b\u0107 ich pobierania oraz ochron\u0119 pracownika (zmiana art. 221 k.p.). Mi\u0119dzy innymi pracodawcy maj\u0105 mie\u0107 mo\u017cliwo\u015b\u0107 przetwarzania adres\u00f3w poczty elektronicznej kandydat\u00f3w do pracy i pracownik\u00f3w oraz ich numer\u00f3w telefonu. Unormowane maj\u0105 tak\u017ce zosta\u0107 zasady wyra\u017cenia zgody przez osob\u0119 ubiegaj\u0105c\u0105 si\u0119 o zatrudnienie lub pracownika na pobranie okre\u015blonych danych osobowych przez pracodawc\u0119 (np. pracodawca ma mie\u0107 mo\u017cliwo\u015b\u0107 przetwarzania danych biometrycznych pracownik\u00f3w w zakresie dotycz\u0105cym stosunku pracy, za ich zgod\u0105). Dalej, ma zosta\u0107 stworzony katalog danych, kt\u00f3rych pobieranie przez pracodawc\u00f3w ma by\u0107 zabronione, nawet za zgod\u0105 osoby, kt\u00f3rej te dane dotycz\u0105. Nowelizacja Kodeksu pracy ma tak\u017ce na celu uregulowanie prawne zasad stosowania przez pracodawc\u00f3w monitoringu, jako szczeg\u00f3lnej formy przetwarzania danych osobowych. Monitoring ma by\u0107 dopuszczalny dla zapewnienia bezpiecze\u0144stwa pracownik\u00f3w lub ochrony mienia albo zachowania w tajemnicy informacji, kt\u00f3rych ujawnienie mog\u0142oby narazi\u0107 pracodawc\u0119 na szkod\u0119. Zabronione ma by\u0107 natomiast stosowanie monitoringu w celu kontroli wykonywania pracy przez pracownik\u00f3w, jak r\u00f3wnie\u017c monitorowanie pomieszcze\u0144 nies\u0142u\u017c\u0105cych do wykonywania pracy, np. pomieszcze\u0144 sanitarnych, szatni, sto\u0142\u00f3wek lub palarni. Do Projektu wprowadzono r\u00f3wnie\u017c podstaw\u0119 prawn\u0105 do pozyskiwania i przechowywania przez pracodawc\u0119 skierowa\u0144 na badania lekarskie oraz orzecze\u0144 lekarskich wydawanych w wyniku tego skierowania, je\u017celi osoba przyjmowana do pracy u innego pracodawcy posiada aktualne orzeczenie lekarskie stwierdzaj\u0105ce brak przeciwwskaza\u0144 do pracy na danym stanowisku.<\/p><p>Poza Kodeksem pracy, Projekt przewiduje zmiany przepis\u00f3w z sektora pracy zawartych tak\u017ce w nast\u0119puj\u0105cych ustawach: o ochronie roszcze\u0144 pracowniczych w razie niewyp\u0142acalno\u015bci pracodawcy (ustawa z dnia 13 lipca 2006 r.), o szczeg\u00f3lnych rozwi\u0105zaniach zwi\u0105zanych z usuwaniem skutk\u00f3w powodzi (ustawa z dnia 16 wrze\u015bnia 2011 r.), o szczeg\u00f3lnych rozwi\u0105zaniach zwi\u0105zanych z ochron\u0105 miejsc pracy (ustawa z dnia 11 pa\u017adziernika 2013 r.).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a5b4690 elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"a5b4690\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
