Prawomocne orzeczenie s\u0105du administracyjnego stwierdzaj\u0105ce niewa\u017cno\u015b\u0107 tego aktu skutkuje jego wyeliminowaniem z porz\u0105dku prawnego ze skutkiem na przesz\u0142o\u015b\u0107, to jest od daty jego wej\u015bcia w \u017cycie. Oznacza to, \u017ce dla oceny prawnej prawid\u0142owo\u015bci wydania wszelkich decyzji administracyjnych przyjmuje si\u0119, \u017ce dany akt nigdy nie istnia\u0142, tj. nie mia\u0142 mocy obowi\u0105zuj\u0105cej.<\/p><p>Zgodnie z odpowiednimi przepisami prawa, rozstrzygni\u0119cia w sprawach indywidualnych \u2013 a wi\u0119c decyzje administracyjne \u2013 wydane na podstawie uchwa\u0142y rady gminy, kt\u00f3rej niewa\u017cno\u015b\u0107 stwierdzi\u0142 s\u0105d administracyjny, podlegaj\u0105 wzruszeniu w trybie okre\u015blonym w post\u0119powaniu administracyjnym albo w post\u0119powaniu szczeg\u00f3lnym. \u017baden przepis kodeksu post\u0119powania administracyjnego ani innego aktu prawnego nie reguluje jednak wprost trybu, w jakim mia\u0142oby nast\u0105pi\u0107 wzruszenie odpowiednich decyzji. Stan ten d\u0142ugo uznawany by\u0142 za luk\u0119 prawn\u0105, chroni\u0105c inwestora, nie maj\u0105cego przecie\u017c formalnie wp\u0142ywu na procedur\u0119 uchwalania planu miejscowego, przed negatywnymi skutkami jego wad prawnych.<\/p><p>W ostatnim czasie pojawi\u0142y si\u0119 jednak orzeczenia Naczelnego S\u0105du Administracyjnego oraz wojew\u00f3dzkich s\u0105d\u00f3w administracyjnych, przyjmuj\u0105ce, i\u017c decyzje administracyjne wydane w oparciu o miejscowy plan zagospodarowania przestrzennego, kt\u00f3rego niewa\u017cno\u015b\u0107 stwierdzono po wydaniu tych decyzji, mog\u0105 by\u0107 uznane za niewa\u017cne na podstawie art. 156 \u00a7 1 pkt 2) kpa, jako wydane bez podstawy prawnej (m.in. wyrok NSA z dnia 25 maja 2012 r., sygn. akt II OSK 400\/11, wyrok WSA w Gda\u0144sku z dnia 6 lutego 2013 r., sygn. akt II SA\/Gd 776\/12, wyrok WSA w Warszawie z dnia 23 lipca 2013 r., sygn. akt VII SA\/Wa 483\/13, wyrok WSA w Krakowie z dnia 9 sierpnia 2012 r., sygn. akt II SA\/Kr 871\/12). S\u0105dy administracyjne argumentuj\u0105, i\u017c plan miejscowy stanowi element podstawy prawnej decyzji w zakresie planowania przestrzennego, za\u015b stwierdzenie jego niewa\u017cno\u015bci ze skutkiem wstecznym prowadzi do uznania, \u017ce w dacie wydawania decyzji administracyjnej nie obowi\u0105zywa\u0142y okre\u015blone w niewa\u017cnym akcie warunki zagospodarowania przestrzennego, do kt\u00f3rych odnosi si\u0119 ta decyzja. Orzeczenia te odwo\u0142uj\u0105 si\u0119 ponadto do wyk\u0142adni dokonanej przez Naczelny S\u0105d Administracyjny w uchwale rozszerzonego sk\u0142adu siedmiu s\u0119dzi\u00f3w NSA z dnia 13 listopada 2012 r. o sygn. akt I OPS 2\/12, w kt\u00f3rej NSA przeanalizowa\u0142 w uj\u0119ciu historycznym istot\u0119 i konsekwencje prawne stwierdzenia niewa\u017cno\u015bci aktu prawnego ze skutkiem wstecznym.<\/p><p>Decyzja o pozwoleniu na budow\u0119 wydawana jest pod warunkiem zgodno\u015bci danej inwestycji z warunkami zagospodarowania przestrzennego. W my\u015bl zatem przedstawionego powy\u017cej pogl\u0105du wyra\u017canego ostatnio w orzecznictwie, stwierdzenie niewa\u017cno\u015bci planu miejscowego po wydaniu takiej decyzji skutkuje wyeliminowaniem, ze skutkiem wstecznym, fragmentu podstawy prawnej rozstrzygni\u0119cia zawartego w decyzji o pozwoleniu na budow\u0119. Sytuacj\u0119 t\u0119 nale\u017cy ocenia\u0107 tak, jakby plan miejscowy nigdy nie istnia\u0142, a zatem przedmiotowa decyzja o pozwoleniu na budow\u0119 zosta\u0142a wydana bez podstawy prawnej, tzn. bez ustalenia warunk\u00f3w zagospodarowania przestrzennego dla inwestycji. Powy\u017csze stanowi z kolei podstaw\u0119 do stwierdzenia niewa\u017cno\u015bci decyzji o pozwoleniu na budow\u0119. Zauwa\u017cy\u0107 nale\u017cy, i\u017c wskazana tendencja w orzecznictwie wp\u0142ywa niekorzystnie na stabilno\u015b\u0107 i przewidywalno\u015b\u0107 procesu inwestycyjnego. W szczeg\u00f3lno\u015bci, stwierdzenie niewa\u017cno\u015bci planu miejscowego nawet ze wzgl\u0119d\u00f3w formalnych (np. niew\u0142a\u015bciwa skala za\u0142\u0105cznika graficznego do planu \u2013 mapki terenu) mo\u017ce prowadzi\u0107 do wstrzymania prac budowlanych b\u0105d\u017a nawet wstrzymania u\u017cytkowania inwestycji, wobec kt\u00f3rej wymagane b\u0119dzie przeprowadzenie post\u0119powania naprawczego.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e2b164d elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"e2b164d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
