(sygn. akt: P 15\/12), uchylaj\u0105cym \u2013 z dat\u0105 jego publikacji w Dzienniku Ustaw RP, tj. 19 lipca 2012 r. \u2013 zdanie drugie art. 76 ust. 1 ustawy z dnia 6 lipca 1982 roku o ksi\u0119gach wieczystych i hipotece (\u201eUKWH\u201d).<\/p><p>Dotychczas art. 76 ust. 1 UKWH posiada\u0142 nast\u0119puj\u0105ce brzmienie: \u201eW razie podzia\u0142u nieruchomo\u015bci hipoteka obci\u0105\u017caj\u0105ca nieruchomo\u015b\u0107 obci\u0105\u017ca wszystkie nieruchomo\u015bci utworzone przez podzia\u0142 (hipoteka \u0142\u0105czna). Hipoteka na cz\u0119\u015bci u\u0142amkowej nieruchomo\u015bci obci\u0105\u017ca w tym samym zakresie cz\u0119\u015bci u\u0142amkowe wszystkich nieruchomo\u015bci utworzonych przez podzia\u0142\u201d. Na mocy wyroku Trybuna\u0142u Konstytucyjnego zdanie drugie cytowanego przepisu utraci\u0142o moc obowi\u0105zuj\u0105c\u0105.<\/p><p>Sens komentowanego przepisu w dotychczasowym brzmieniu warto zobrazowa\u0107 na przyk\u0142adzie. Je\u017celi budynek, w kt\u00f3rym znajdowa\u0142o si\u0119 dziesi\u0119\u0107 mieszka\u0144, by\u0142 wsp\u00f3\u0142w\u0142asno\u015bci\u0105 dziesi\u0119ciu os\u00f3b, a tylko dwie z nich zaci\u0105gn\u0119\u0142y kredyt, kt\u00f3ry zosta\u0142 zabezpieczony hipotek\u0105 ustanowion\u0105 na udzia\u0142ach we wsp\u00f3\u0142w\u0142asno\u015bci kredytobiorc\u00f3w, to na skutek zniesienia wsp\u00f3\u0142w\u0142asno\u015bci hipoteka obci\u0105\u017ca\u0142a wszystkie cz\u0119\u015bci u\u0142amkowe w utworzonych przez podzia\u0142 nieruchomo\u015bciach, a wi\u0119c nawet os\u00f3b, kt\u00f3re nie zaci\u0105gn\u0119\u0142y kredytu. Wierzyciel (bank) m\u00f3g\u0142 \u017c\u0105da\u0107 zaspokojenia swej wierzytelno\u015bci z tytu\u0142u udzielonego kredytu w ca\u0142o\u015bci lub w cz\u0119\u015bci z ka\u017cdej z nieruchomo\u015bci, z kilku z nich lub ze wszystkich \u0142\u0105cznie. Uchylony przepis kreowa\u0142 zatem mo\u017cliwo\u015b\u0107 powstania odpowiedzialno\u015bci za cudze d\u0142ugi.<\/p><p>Jeden z s\u0105d\u00f3w rejonowych powzi\u0105\u0142 w\u0105tpliwo\u015b\u0107 co do konstytucyjno\u015bci zdania drugiego omawianego przepisu. Przedstawiono zatem Trybuna\u0142owi Konstytucyjnemu pytanie prawne, czy art. 76 ust. 1 zdanie drugie UKWH jest zgodny z: zasadami ochrony w\u0142asno\u015bci okre\u015blonymi w Konstytucji oraz w Protokole nr 1 do Konwencji o ochronie praw cz\u0142owieka i podstawowych wolno\u015bci (w tym dopuszczalnymi ustawowymi wyj\u0105tkami od tej zasady), oraz z konstytucyjn\u0105 zasad\u0105 r\u00f3wno\u015bci wobec prawa.<\/p><p>Trybuna\u0142 Konstytucyjny orzek\u0142, \u017ce omawiany przepis jest niezgodny z konstytucyjnymi zasadami ochrony w\u0142asno\u015bci, uzna\u0142 jednak przepis ten za sp\u00f3jny z zasadami r\u00f3wno\u015bci wobec prawa, w tym r\u00f3wno\u015bci w ochronie prawa w\u0142asno\u015bci, przewidzianymi przez Konstytucj\u0119.<\/p><p>Wed\u0142ug uzasadnienia Trybuna\u0142u Konstytucyjnego za uznaniem komentowanej normy jako niezgodnej z konstytucyjnymi zasadami ochrony w\u0142asno\u015bci przemawia\u0142 negatywny wynik testu proporcjonalno\u015bci przewidzianego w Konstytucji, rozumianego jako ocena trzech zasad: zasady przydatno\u015bci, konieczno\u015bci oraz nadmiernej ingerencji. Trybuna\u0142 Konstytucyjny stwierdzi\u0142, \u017ce ustawodawca, wprowadzaj\u0105c omawiany przepis, dokona\u0142 wyboru, kt\u00f3remu z dw\u00f3ch praw przyzna\u0107 wi\u0119ksz\u0105 ochron\u0119 prawn\u0105, w wyniku kt\u00f3rego przypisa\u0142 priorytet ochronie wierzyciela przed utrat\u0105 zabezpieczenia. Trybuna\u0142 uzna\u0142 jednak, i\u017c w sytuacji zbiegu norm dotycz\u0105cych prawa w\u0142asno\u015bci i wierzytelno\u015bci zabezpieczonej hipotek\u0105 ochronie powinna podlega\u0107 przede wszystkim w\u0142asno\u015b\u0107, przewidziana wprost przez Konstytucj\u0119 jako prawo nadrz\u0119dne; zaznaczy\u0107 nale\u017cy, \u017ce cz\u0119\u015bci\u0105 prawa w\u0142asno\u015bci jest prawo wsp\u00f3\u0142w\u0142a\u015bciciela do \u017c\u0105dania zniesienia wsp\u00f3\u0142w\u0142asno\u015bci. W ocenie Trybuna\u0142u Konstytucyjnego skutki wzmocnienia ochrony wierzytelno\u015bci omawianym przepisem, s\u0105 nieproporcjonalnie niekorzystne dla w\u0142a\u015bciciela w stosunku do korzy\u015bci uzyskanych przez wierzyciela. Obowi\u0105zywanie omawianego przepisu w dotychczasowym brzmieniu bywa\u0142o nierzadko powodem niedoj\u015bcia transakcji do skutku.
