Bez niego bowiem niemo\u017cliwe jest uzyskanie pozwolenia na budow\u0119. Rozpocz\u0119cie prac bez wa\u017cnego pozwolenia na budow\u0119, jest r\u00f3wnoznaczne z dopuszczeniem si\u0119 samowoli budowlanej. W takim wypadku inwestorowi grozi nawet obowi\u0105zek rozbi\u00f3rki obiektu lub doprowadzenia go do stanu poprzedniego.<\/p><p>Aby unikn\u0105\u0107 negatywnych konsekwencji, zasadne jest zapoznanie si\u0119 ze szczeg\u00f3\u0142owymi wymaganiami, jakie powinien spe\u0142nia\u0107 ka\u017cdy projekt budowlany jeszcze przed rozpocz\u0119ciem prac. Warto wi\u0119c wiedzie\u0107, \u017ce 29 kwietnia 2012 r. wesz\u0142y w \u017cycie przepisy nowego Rozporz\u0105dzenia Ministra Transportu, Budownictwa i Gospodarki Morskiej z dnia 25 kwietnia 2012 r. w sprawie szczeg\u00f3\u0142owego zakresu i formy projektu budowlanego (Dz. U. z 2012 r. poz. 462). Aktualne rozporz\u0105dzenie zast\u0105pi\u0142o w ca\u0142o\u015bci dotychczas obowi\u0105zuj\u0105ce przepisy wykonawcze do Ustawy z dnia 7 lipca 1994 r. \u2013 Prawo budowlane (Dz. U. z 2010 r. Nr 243, poz. 1623 z p\u00f3\u017a. zm.) tj. Rozporz\u0105dzenie Ministra Infrastruktury z dnia 3 lipca 2003 r. o tym samym tytule, tj. w sprawie szczeg\u00f3\u0142owego zakresu i formy projektu budowlanego.<\/p><p>Nowe rozporz\u0105dzenie, opr\u00f3cz uporz\u0105dkowania dotychczas obowi\u0105zuj\u0105cych regulacji prawnych wprowadza unormowania normalizacyjne w odniesieniu do zasad obliczania powierzchni u\u017cytkowej budynk\u00f3w mieszkalnych, w tym lokali mieszkalnych. W poprzednim rozporz\u0105dzeniu pr\u00f3\u017cno by\u0142o szuka\u0107 precyzyjnego wskazania Polskiej Normy, wed\u0142ug kt\u00f3rej mia\u0142a by\u0107 okre\u015blana powierzchnia u\u017cytkowa w projekcie budowlanym, co powodowa\u0142o, \u017ce ustalenie powierzchni u\u017cytkowej budzi\u0142o wiele kontrowersji z uwagi na stosowanie r\u00f3\u017cnych zasad jej obliczania. Ro\u017cnice w obliczeniach dochodzi\u0142y nawet do kilku metr\u00f3w kwadratowych i mog\u0142y wywo\u0142ywa\u0107 niekorzystne skutki, w szczeg\u00f3lno\u015bci dla nabywc\u00f3w lokali od deweloper\u00f3w. Rozporz\u0105dzenie z dnia 25 kwietnia 2012 r. wprowadzi\u0142o wi\u0119c jednoznaczne zasady obliczania powierzchni nowybudowanych budynk\u00f3w, polegaj\u0105ce na powo\u0142aniu w przepisach Polskiej Normy PN-ISO 9836:1997 W\u0142a\u015bciwo\u015bci u\u017cytkowe w budownictwie. Okre\u015blenie wska\u017anik\u00f3w powierzchniowych i kubaturowych.<\/p><p>Nowe rozporz\u0105dzenie wprowadza r\u00f3wnie\u017c obowi\u0105zek okre\u015blenia charakterystyki energetycznej budynku w projekcie budowlanym obiekt\u00f3w budowlanych o prostej konstrukcji, jak budynki mieszkalne jednorodzinne, niewielkie obiekty gospodarcze, inwentarskie i sk\u0142adowe. Dotychczasowe zapisy wyra\u017anie wskazywa\u0142y na brak obowi\u0105zku okre\u015blenia charakterystyki energetycznej w odniesieniu do powy\u017cszych budynk\u00f3w.<\/p><p>Ponadto akt wykonawczy do Ustawy Prawo budowlane, kt\u00f3ry wszed\u0142 w \u017cyciu w dniu 29 kwietnia 2012 r. nak\u0142ada obowi\u0105zek okre\u015blenia w cz\u0119\u015bci rysunkowej projektu, sporz\u0105dzonej na mapie, oznaczenie przebiegu dr\u00f3g po\u017carowych oraz doj\u015b\u0107 \u0142\u0105cz\u0105cych wyj\u015bcia z obiekt\u00f3w budowlanych z drog\u0105 po\u017carow\u0105.<\/p><p>Przed wydaniem decyzji o pozwoleniu na budow\u0119 w\u0142a\u015bciwy organ sprawdza zgodno\u015b\u0107 projektu budowlanego pod wzgl\u0119dem spe\u0142nienia szeregu wymog\u00f3w, w tym zgodno\u015bci z przepisami, r\u00f3wnie\u017c tymi techniczno-budowlanymi. Dlatego warto \u015bledzi\u0107 na bie\u017c\u0105co aktualizacje szczeg\u00f3\u0142owych wymog\u00f3w w tym zakresie. W razie stwierdzenia narusze\u0144, organ ten nak\u0142ada bowiem obowi\u0105zek usuni\u0119cia wskazanych nieprawid\u0142owo\u015bci w zakre\u015blonym terminie.
