Trybuna\u0142 Konstytucyjny wyda\u0142 wyrok, w kt\u00f3rym odni\u00f3s\u0142 si\u0119 do problematyki zgodno\u015bci z Konstytucj\u0105 pierwotnego brzmienia art. 14 ustawy o recyklingu pojazd\u00f3w wycofanych z eksploatacji (Dz. U. z 2005 r. nr 25 poz. 202 z p\u00f3\u017a. zm.) (dalej jako: \u201eUstawa\u201d). Ustawa ta nak\u0142ada na przedsi\u0119biorc\u00f3w b\u0119d\u0105cych producentami lub importerami nowych samochod\u00f3w obowi\u0105zek ustanowienia sieci zbierania pojazd\u00f3w wycofanych z eksploatacji. Sie\u0107 taka powinna obj\u0105\u0107 swym zasi\u0119giem terytorium ca\u0142ego kraju w ten spos\u00f3b, aby ka\u017cdy w\u0142a\u015bciciel pojazdu m\u00f3g\u0142 go odda\u0107 do w\u0142a\u015bciwego punktu zbioru lub stacji demonta\u017cu. Zgodnie z pierwotn\u0105 wersj\u0105 art. 14 Ustawy, w sytuacji, gdy przedsi\u0119biorca wprowadzaj\u0105cy samoch\u00f3d na rynek nie zapewni\u0142 takiej mo\u017cliwo\u015bci, musia\u0142 ui\u015bci\u0107 op\u0142at\u0119 recyklingow\u0105 w kwocie 500 z\u0142 od ka\u017cdego wprowadzonego do obrotu pojazdu. Tym samym, przepis zr\u00f3wnywa\u0142 w swej tre\u015bci przedsi\u0119biorc\u00f3w, kt\u00f3rzy podj\u0119li wysi\u0142ek stworzenia sieci demonta\u017cu samochod\u00f3w, ale nie uda\u0142o si\u0119 ni\u0105 obj\u0105\u0107 powierzchni ca\u0142ego kraju, i tych, kt\u00f3rzy ca\u0142kowicie zlekcewa\u017cyli ten ustawowy obowi\u0105zek.<\/p><p>W drodze nowelizacji z 25 wrze\u015bnia 2007 r. ustawodawca zmieni\u0142 tre\u015b\u0107 art. 14 Ustawy uzale\u017cniaj\u0105c konieczno\u015b\u0107 wniesienia op\u0142aty recyklingowej od stopnia zaawansowania prac nad stworzeniem sieci zbierania pojazd\u00f3w. W przypadku, gdy obejmowa\u0142a ona co najmniej 95 % terytorium kraju przedsi\u0119biorcy zostali zwolnieni z op\u0142aty, a osi\u0105gni\u0119cie enumeratywnie wskazanych w ustawie prog\u00f3w pozwala\u0142o na proporcjonalne zmniejszanie op\u0142aty w stosunku do zakresu terytorialnego sieci. Jednocze\u015bnie w art. 2 ustawy nowelizuj\u0105cej z wrze\u015bnia 2007 zawarto przepis przej\u015bciowy, kt\u00f3ry nakazywa\u0142 stosowanie nowej regulacji do op\u0142at za 2007 r. Poniewa\u017c przepis ten nie wspomina o zasadach obliczania op\u0142aty za brak sieci za okres poprzedzaj\u0105cy, stosuj\u0105c wyk\u0142adni\u0119 a contrario przyj\u0119to, i\u017c do obliczania op\u0142at za brak sieci za 2006 r. stosowa\u0107 nale\u017cy przepisy w pierwotnym brzmieniu ustawy z 2005 r.<\/p><p>Na kanwie tych uregulowa\u0144 pytanie prawne do Trybuna\u0142u Konstytucyjnego (dalej r\u00f3wnie\u017c jako \u201eTK\u201d) skierowa\u0142 Wojew\u00f3dzki S\u0105d Administracyjny w Warszawie, wyra\u017caj\u0105c w\u0105tpliwo\u015b\u0107 co do konstytucyjno\u015bci art. 14 Ustawy w jego pierwotnym brzmieniu.<\/p><p>Trybuna\u0142 Konstytucyjny nie podzieli\u0142 w\u0105tpliwo\u015bci s\u0105du administracyjnego co do naruszenia przez ustawodawc\u0119 zasady proporcjonalno\u015bci w regulacji op\u0142aty za brak sieci w jej pierwotnym brzmieniu. Trybuna\u0142 wskaza\u0142, \u017ce op\u0142ata recyklingowa, w swej istocie nie mia\u0142a charakteru represji. Jej podstawowym celem by\u0142a bowiem mobilizacja przedsi\u0119biorc\u00f3w wprowadzaj\u0105cych samochody na polski rynek do stworzenia sieci umo\u017cliwiaj\u0105cej w\u0142a\u015bciw\u0105 utylizacj\u0119 wyeksploatowanych pojazd\u00f3w. Ponadto TK podkre\u015bli\u0142, \u017ce pierwotna regulacja przewidywa\u0142a mo\u017cliwo\u015b\u0107 miarkowania wysoko\u015bci nale\u017cnej op\u0142aty za brak sieci. Jej wysoko\u015b\u0107 stanowi\u0142a nie tylko iloczyn stawki 500 z\u0142 i liczby pojazd\u00f3w wprowadzonych na terytorium kraju, ale r\u00f3wnie\u017c uj\u0119tej procentowo liczby dni w roku, w kt\u00f3rych nie zapewniono sieci. Przedsi\u0119biorcy, kt\u00f3rym z czasem uda\u0142o si\u0119 osi\u0105gn\u0105\u0107 odpowiedni zakres sieci demonta\u017cu p\u0142acili proporcjonalnie ni\u017csz\u0105 op\u0142at\u0119. Poza tym, jak wskaza\u0142 Trybuna\u0142, poniesione op\u0142aty, o kt\u00f3rych mowa w art. 14 Ustawy, mog\u0142y zosta\u0107 wliczone w koszty uzyskania przychod\u00f3w, co by\u0142o rozwi\u0105zaniem korzystnym dla wprowadzaj\u0105cych pojazdy. Ostatecznie, TK orzek\u0142, \u017ce &#8211; art. 14 Ustawy w brzmieniu obowi\u0105zuj\u0105cym do dnia wej\u015bcia w \u017cycie ustawy nowelizuj\u0105cej z 2007 r., w zakresie w jakim nie r\u00f3\u017cnicowa\u0142 wysoko\u015bci op\u0142aty za brak sieci z uwagi na stopie\u0144 pokrycia sieci\u0105 terytorium kraju, jest zgodny z art. 2 Konstytucji (zasad\u0105 adekwatno\u015bci (proporcjonalno\u015bci) rozwi\u0105za\u0144 ustawodawczych do zak\u0142adanego celu regulacji). TK uzna\u0142 tak\u017ce, \u017ce art. 2 ustawy z 29 czerwca 2007 r. w zakresie, w jakim nakazuje stosowa\u0107 do obliczania op\u0142aty za brak sieci w 2006 r. art. 14 Ustawy w pierwotnym brzmieniu, jest zgodny z wyprowadzan\u0105 z art. 2 konstytucji zasad\u0105 adekwatno\u015bci (proporcjonalno\u015bci) rozwi\u0105za\u0144 ustawodawczych do zak\u0142adanego celu regulacji.<\/p><p>Rozstrzygni\u0119cie Trybuna\u0142u sprawia, \u017ce przedsi\u0119biorcy, kt\u00f3rzy przed nowelizacj\u0105 ustawy nie utworzyli pe\u0142nej sieci demonta\u017cu pojazd\u00f3w b\u0119d\u0105 zobowi\u0105zani do zap\u0142aty zaleg\u0142ych op\u0142at recyklingowych.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-20d8203 elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"20d8203\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
