U. z 2007 r. nr 19 poz. 115 j.t. z p\u00f3\u017c. zm.) drogi krajowe stanowi\u0105 w\u0142asno\u015b\u0107 Skarbu Pa\u0144stwa, za\u015b drogi wojew\u00f3dzkie, drogi powiatowe i drogi gminne stanowi\u0105 w\u0142asno\u015b\u0107 w\u0142a\u015bciwego samorz\u0105du wojew\u00f3dztwa, powiatu lub gminy. Mimo powy\u017cszego zapisu, w praktyce obrotu prawnego przez wiele lat mo\u017cna by\u0142o spotka\u0107 si\u0119 z sytuacj\u0105, w kt\u00f3rej droga publiczna zosta\u0142a zrealizowana na nieruchomo\u015bciach stanowi\u0105cych w\u0142asno\u015b\u0107 os\u00f3b trzecich. Opisana wy\u017cej sytuacja prowadzi\u0142a de facto do faktycznego wyw\u0142aszczenia w\u0142a\u015bcicieli takich nieruchomo\u015bci, kt\u00f3rzy nie mogli tym samym rozporz\u0105dza\u0107 swoim prawem w\u0142asno\u015bci. Maj\u0105c powy\u017csze na uwadze, ustawodawca postanowi\u0142 zlikwidowa\u0107 powsta\u0142\u0105 niezgodno\u015b\u0107 stanu faktycznego ze stanem prawnym wprowadzaj\u0105c przepisy ustawy z dnia 13 pa\u017adziernika 1998 r. &#8211; Przepisy wprowadzaj\u0105ce ustawy reformuj\u0105ce administracj\u0119 publiczn\u0105 (Dz. U. z 1998 r. nr 133 poz. 872 z p\u00f3\u017a. zm.) (dalej jako: \u201eUstawa\u201d).<\/p><p>Zgodnie z dyspozycj\u0105 art. 73 ust. 1 Ustawy nieruchomo\u015bci pozostaj\u0105ce w dniu 31 grudnia 1998 r. we w\u0142adaniu Skarbu Pa\u0144stwa lub jednostek samorz\u0105du terytorialnego, niestanowi\u0105ce ich w\u0142asno\u015bci, a zaj\u0119te pod drogi publiczne, z dniem 1 stycznia 1999 r. sta\u0142y si\u0119 z mocy prawa w\u0142asno\u015bci\u0105 Skarbu Pa\u0144stwa lub w\u0142a\u015bciwych jednostek samorz\u0105du terytorialnego za odszkodowaniem.<br \/>Dzi\u0119ki wprowadzonemu rozwi\u0105zaniu Skarb Pa\u0144stwa oraz jednostki samorz\u0105du terytorialnego mia\u0142y naby\u0107 tytu\u0142y prawne do nieruchomo\u015bci zaj\u0119tych pod drogi publiczne. Opisana wy\u017cej regulacja nie rozwi\u0105za\u0142a wszystkich problem\u00f3w zwi\u0105zanych z ustaleniem stanu prawnego wskazanych nieruchomo\u015bci. W po\u0142\u0105czonych do wsp\u00f3lnego rozpoznania sprawach rozstrzygni\u0119tych przez S\u0105d Najwy\u017cszy postanowieniem z dnia 17 maja 2012 r., sygn. I CSK 408\/11, jednostka samorz\u0105du terytorialnego oraz Skarb Pa\u0144stwa wyst\u0105pili z wnioskami o zasiedzenie nieruchomo\u015bci stanowi\u0105cych drogi o nieuregulowanym stanie prawnym. W stosunku do nieruchomo\u015bci obj\u0119tych prowadzonym post\u0119powaniem nie zosta\u0142 wydany \u017caden akt nadaj\u0105cy im status dr\u00f3g publicznych, ale by\u0142y one wykorzystywane w tym charakterze. Wnioskodawcy wykazywali, \u017ce od lat drogi b\u0119d\u0105ce przedmiotem prowadzonego post\u0119powania by\u0142y administrowane przez wskazane podmioty, co \u015bwiadczy o samoistnym posiadaniu przedmiotowych nieruchomo\u015bci przez wnioskodawc\u00f3w. Rozpatruj\u0105c przedstawion\u0105 spraw\u0119 S\u0105d Najwy\u017cszy uzna\u0142, \u017ce nieruchomo\u015b\u0107 wykorzystywana od lat jako droga publiczna nie mo\u017ce by\u0107 przedmiotem posiadania samoistnego prowadz\u0105cego do zasiedzenia jej przez osob\u0119 trzeci\u0105. Zdaniem S\u0105du Najwy\u017cszego opisane przez wnioskodawc\u00f3w dzia\u0142ania zwi\u0105zane z administrowaniem nieruchomo\u015bciami b\u0119d\u0105cymi przedmiotem prowadzonego post\u0119powania mia\u0142o charakter w\u0142adztwa publicznego, a wi\u0119c by\u0142o dokonywane dla dobra publicznego. Tymczasem przes\u0142ank\u0105 zasiedzenia nieruchomo\u015bci w rozumieniu art. 336 kc w zw. z art. 172 kc jest inna posta\u0107 w\u0142adztwa nad rzecz\u0105, tj. w\u0142adztwo dla siebie. W konsekwencji, S\u0105d Najwy\u017cszy uzna\u0142, \u017ce w\u0142adanie nieruchomo\u015bciami drogowymi w spos\u00f3b, w jaki czynili to wnioskodawcy, nie m\u00f3g\u0142 prowadzi\u0107 do zasiedzenia nieruchomo\u015bci b\u0119d\u0105cych przedmiotem prowadzonego post\u0119powania.<\/p><p>Opisane wy\u017cej stanowisko S\u0105du Najwy\u017cszego mo\u017ce utrudni\u0107 regulacj\u0119 stanu prawnego nieruchomo\u015bci zaj\u0119tych pod drogi. Istniej\u0105 bowiem nieruchomo\u015bci, kt\u00f3re nie sta\u0142y si\u0119 w\u0142asno\u015bci\u0105 Skarbu Pa\u0144stwa lub jednostki samorz\u0105du terytorialnego na podstawie art. 73 Ustawy, gdy\u017c nie spe\u0142nia\u0142y przes\u0142anek wskazanych w powo\u0142anym przepisie (np. brak formalnego zaliczenia danej drogi do kategorii dr\u00f3g publicznych). Jak si\u0119 wydaje, om\u00f3wione wy\u017cej postanowienie S\u0105du Najwy\u017cszego z dnia 17 maja 2012 r. uniemo\u017cliwia uregulowanie stanu prawnego przedmiotowych nieruchomo\u015bci w drodze ich zasiedzenia.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9296c4e elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"9296c4e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
