Przepisy tej ustawy zmieniaj\u0105 m.in. przepisy Kodeksu pracy w cz\u0119\u015bci dotycz\u0105cej urlopu macierzy\u0144skiego, dodatkowego urlopu macierzy\u0144skiego, dodatkowego urlopu na warunkach urlopu macierzy\u0144skiego i urlopu rodzicielskiego oraz przepisy Ustawy z dnia 25 czerwca 1999 r. o \u015bwiadczeniach pieni\u0119\u017cnych z ubezpieczenia spo\u0142ecznego w razie choroby i macierzy\u0144stwa w zakresie dotycz\u0105cym zasi\u0142ku macierzy\u0144skiego. W poni\u017cszym artykule skoncentrowano si\u0119 przede wszystkim na analizie wymienionych nowelizacji pod k\u0105tem nowych obowi\u0105zk\u00f3w pracodawc\u00f3w.<\/p><p>Po nowelizacji przepis\u00f3w pracodawcy musz\u0105 przede wszystkim prawid\u0142owo okre\u015bli\u0107 przys\u0142uguj\u0105c\u0105 danemu pracownikowi d\u0142ugo\u015b\u0107 urlopu macierzy\u0144skiego i urlopu rodzicielskiego. Po zmianach, d\u0142ugo\u015b\u0107 urlopu mo\u017ce wynosi\u0107 52 tygodnie w przypadku urodzenia jednego dziecka i od 65 do<br \/>71 tygodni w przypadku urodzenia wi\u0119kszej ilo\u015bci dzieci. Wymiar taki jest mo\u017cliwy dzi\u0119ki wyd\u0142u\u017ceniu okresu dodatkowego urlopu macierzy\u0144skiego (a tak\u017ce dodatkowego urlopu na warunkach urlopu macierzy\u0144skiego) o 2 tygodnie i wprowadzeniu nowego urlopu rodzicielskiego w wymiarze 26 tygodni. Urlop rodzicielski udzielany jest na okres 26 tygodni niezale\u017cnie od liczby dzieci urodzonych przy jednym porodzie. Pracodawca udziela tych urlop\u00f3w na pisemny wniosek pracownika, przy czym powinien on zweryfikowa\u0107, czy pracownik wyst\u0105pi\u0142 o prawid\u0142owy wymiar urlopu i zachowa\u0142 w\u0142a\u015bciwy termin do z\u0142o\u017cenia wniosku w tej sprawie. Nowa ustawa przewiduje skorzystanie z dodatkowego urlopu macierzy\u0144skiego i rodzicielskiego przez z\u0142o\u017cenie dw\u00f3ch osobnych wniosk\u00f3w, ka\u017cdego w terminie nie kr\u00f3tszym ni\u017c 14 dni przed rozpocz\u0119ciem si\u0119 danego urlopu lub przez z\u0142o\u017cenie jednego wniosku o oba te urlopy, ale nie p\u00f3\u017aniej ni\u017c 14 dni po porodzie. Niedotrzymanie terminu skutkuje mo\u017cliwo\u015bci\u0105 odmowy przez pracodawc\u0119 jego udzielenia.<\/p><p>Nieco odmienna sytuacja jest przy urlopie rodzicielskim. Z urlopu tego b\u0119d\u0105 mog\u0142y skorzysta\u0107 nie tylko matki, ale i r\u00f3wnie\u017c ojcowie, albo w ca\u0142o\u015bci albo dziel\u0105c si\u0119 mi\u0119dzy sob\u0105 cz\u0119\u015bci\u0105 urlopu. Urlop taki mo\u017cna podzieli\u0107 tylko na trzy cz\u0119\u015bci i ka\u017cda z nich nie mo\u017ce by\u0107 kr\u00f3tsza ni\u017c 8 tygodni. To, w jaki spos\u00f3b rodzice wykorzystaj\u0105 urlop rodzicielski b\u0119dzie zale\u017ca\u0142o tylko od nich, natomiast pracodawca mo\u017ce odm\u00f3wi\u0107 udzielenia urlopu rodzicielskiego, je\u017celi pracownik b\u0119dzie wnioskowa\u0142 o ten urlop w wymiarze kr\u00f3tszym ni\u017c 8 tygodni. Nowo\u015bci\u0105 jest tak\u017ce mo\u017cliwo\u015b\u0107 odm\u00f3wienia przez pracodawc\u0119 podj\u0119cia pracy w czasie dodatkowego urlopu macierzy\u0144skiego lub urlopu rodzicielskiego. Pracodawca mo\u017ce nie wyrazi\u0107 zgody na tak\u0105 prac\u0119, je\u017celi nie jest to mo\u017cliwe ze wzgl\u0119du na organizacj\u0119 pracy lub rodzaj wykonywanej przez pracownika pracy.<\/p><p>Istotna zmiana dotychczasowych przepis\u00f3w pojawi\u0142a si\u0119 tak\u017ce w zakresie wysoko\u015bci zasi\u0142ku macierzy\u0144skiego. Nale\u017cy przypomnie\u0107, \u017ce podstaw\u0119 wymiaru dla zasi\u0142k\u00f3w macierzy\u0144skich stanowi przeci\u0119tne wynagrodzenie wyp\u0142acane w ci\u0105gu ostatnich 12 miesi\u0119cy kalendarzowych. Od 17 czerwca pracodawcy musz\u0105 zastosowa\u0107 r\u00f3\u017cne stopy procentowe do obliczania kwoty zasi\u0142ku. Wysoko\u015b\u0107 stopy procentowej uzale\u017cniona b\u0119dzie od momentu, w kt\u00f3rym ubezpieczona zadeklaruje, z jakich urlop\u00f3w chce skorzysta\u0107. Do tej pory zasi\u0142ek w czasie urlopu macierzy\u0144skiego (oraz dodatkowego urlopu macierzy\u0144skiego) wynosi\u0142 100% podstawy wymiaru zasi\u0142ku. Natomiast obecnie zasi\u0142ek za czas trwania urlopu rodzicielskiego wyniesie 60% podstawy wymiaru zasi\u0142ku, za wyj\u0105tkiem sytuacji, kiedy pracownica z\u0142o\u017cy pracodawcy jeszcze przed urodzeniem si\u0119 dziecka wniosek o udzielenie jej bezpo\u015brednio po urlopie macierzy\u0144skim dodatkowego urlopu macierzy\u0144skiego a zaraz po nim urlopu rodzicielskiego. W\u00f3wczas przez ca\u0142y ten okres zasi\u0142ek wyniesie 80% podstawy wymiaru zasi\u0142ku. Nale\u017cy wspomnie\u0107, \u017ce pracownica, kt\u00f3ra z\u0142o\u017cy\u0142a wniosek o urlop rodzicielski jeszcze przed porodem mo\u017ce zrezygnowa\u0107 z niego w ca\u0142o\u015bci. W takiej sytuacji nale\u017cy wyp\u0142aci\u0107 jej wyr\u00f3wnanie zasi\u0142ku macierzy\u0144skiego za okres urlopu macierzy\u0144skiego i dodatkowego urlopu macierzy\u0144skiego do 100% podstawy wymiaru zasi\u0142ku macierzy\u0144skiego. Jednak\u017ce w przypadku, gdyby pracownica zdecydowa\u0142a si\u0119 jednocze\u015bnie na urlop rodzicielski i dodatkowy urlop macierzy\u0144ski, to wysoko\u015b\u0107 zasi\u0142ku w tym przypadku wynosi 60% podstawy wymiaru zasi\u0142ku.<\/p><p>Nowe regulacje maj\u0105 zastosowanie do os\u00f3b, kt\u00f3rych dzieci urodzi\u0142y si\u0119 po 31 grudnia 2012 roku, a tak\u017ce do os\u00f3b, kt\u00f3re przyj\u0119\u0142y po 31 grudnia 2012 roku na wychowanie dziecko w wieku do 7 roku \u017cycia, a w przypadku, gdy wobec dziecka odroczono obowi\u0105zek szkolny \u2013 dziecka w wieku do 10 roku \u017cycia i wyst\u0105pi\u0142y do s\u0105du opieku\u0144czego z wnioskiem o wszcz\u0119cie post\u0119powania w sprawie jego przysposobienie lub przyj\u0119\u0142y na wychowanie dziecko jako rodzina zast\u0119pcza (z wyj\u0105tkiem rodziny zawodowej).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d7c62a8 elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"d7c62a8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
