Nakaz rozbi\u00f3rki jest zatem ostateczno\u015bci\u0105. Jednocze\u015bnie, polskie przepisy dotycz\u0105ce op\u0142aty legalizacyjnej rozr\u00f3\u017cniaj\u0105 dwie sytuacje. Po pierwsze, gdy obiekt zosta\u0142 wykonany bez uzyskania wymaganego pozwolenia na budow\u0119, po drugie, gdy prace zosta\u0142y wykonane bez uzyskania wymaganego zg\u0142oszenia. W pierwszym przypadku, spos\u00f3b wyliczenia op\u0142aty legalizacyjnej okre\u015bla przepis art. 49 ust. 2 ustawy z dnia 7 lipca 2004 Prawo budowlane (dalej \u201eUstawa\u201d), kt\u00f3ry nakazuje stosowa\u0107 odpowiednio przepisy dotycz\u0105ce kar, o kt\u00f3rych mowa w art. 59 f Ustawy, z tym, \u017ce kwota wyliczona na podstawie art. 59 f musi by\u0107 przemno\u017cona przez liczb\u0119 50. Formu\u0142a zawarta w art. 59 f jest nast\u0119puj\u0105ca, kar\u0119 stanowi iloczyn stawki op\u0142aty (s), wsp\u00f3\u0142czynnika kategorii obiektu budowlanego (k) oraz wsp\u00f3\u0142czynnika wielko\u015bci obiektu budowlanego (w). Stawka op\u0142aty, wed\u0142ug ust. 2 tego\u017c przepisu, wynosi 500 z\u0142, natomiast stanowi\u0105ce cz\u0119\u015b\u0107 formu\u0142y wsp\u00f3\u0142czynniki znajduj\u0105 si\u0119 w za\u0142\u0105czniku do Ustawy. Za samowol\u0119 budowlan\u0105 pope\u0142nion\u0105 bez wymaganego zg\u0142oszenia, ustalono sztywne kary kwotowe w wysoko\u015bci 2500 lub 5000, w zale\u017cno\u015bci od charakteru budowy.<\/p><p>Z powy\u017cszego wynika, \u017ce o ile legalizacja samowoli budowlanej dokonanej bez zg\u0142oszenia nie poci\u0105ga za sob\u0105 nadmiernie dotkliwych konsekwencji finansowych, o tyle wybudowanie obiektu bez wymaganego pozwolenia na budow\u0119 mo\u017ce postawi\u0107 w w\u0105tpliwo\u015b\u0107 op\u0142acalno\u015b\u0107 procesu legalizacyjnego.<br \/>W zwi\u0105zku z wysokim stopniem represyjno\u015bci op\u0142aty legalizacyjnej cz\u0119sto bardziej op\u0142aca si\u0119 rozebra\u0107 obiekt i dokona\u0107 ponownej budowy na podstawie otrzymanego pozwolenia ni\u017c ui\u015bci\u0107 wyliczon\u0105 z formu\u0142y kwot\u0119. Niestety, konstrukcja formu\u0142y wyliczania op\u0142aty nie obrazuje wysoko\u015bci,<br \/>jakich nale\u017cy si\u0119 spodziewa\u0107 przy dokonywaniu legalizacji. Przyk\u0142adowo za legalizacj\u0119 sklepu czy baru o kubaturze do 2500 m 3 b\u0119dzie trzeba ui\u015bci\u0107 op\u0142at\u0119 w kwocie 375 000 z\u0142, a za sklep od 2500 do 5000 m 3 \u2013 562.500 PLN. Najwi\u0119ksz\u0105 niesprawiedliwo\u015bci\u0105 obecnie obowi\u0105zuj\u0105cych przepis\u00f3w jest to, \u017ce inwestor zap\u0142aci tyle samo za budow\u0119 ma\u0142ego sklepu jak i tego o kubaturze 2000 m 3, jako \u017ce oba obiekty nale\u017c\u0105 do tej samej kategorii obiekt\u00f3w wymienionych w za\u0142\u0105czniku do Ustawy.<br \/>Tak restrykcyjne uj\u0119cie op\u0142at sprawia, \u017ce rok rocznie notowany jest spadek legalizacji samowoli budowlanych. W 2009 r. zalegalizowano 681 samowoli budowlanych, w 2010 ju\u017c tylko 571, a w pierwszym p\u00f3\u0142roczu 2011 liczba ta spad\u0142a do 182.<\/p><p>By zniwelowa\u0107 t\u0119 wyst\u0119puj\u0105c\u0105 obecnie niesprawiedliwo\u015b\u0107 w za\u0142o\u017ceniach do projektu prawa budowlanego proponuje si\u0119 wprowadzenie op\u0142aty legalizacyjnej w wysoko\u015bci 50 procent warto\u015bci budowanego obiektu. Nie wiadomo jednak, czy taka op\u0142ata wyliczana by\u0142aby od warto\u015bci wykonanych prac do momentu rozpocz\u0119cia procesu legalizacyjnego czy od warto\u015bci maj\u0105cego w przysz\u0142o\u015bci powsta\u0107 obiektu. Pan Janusz \u017bbik, Wiceminister Transportu, Budownictwa i Gospodarki Wodnej stwierdzi\u0142, \u017ce planowane jest wprowadzenie przepis\u00f3w, tak by nikomu nie op\u0142aca\u0142o si\u0119 budowa\u0107 z naruszeniem przepis\u00f3w prawa. Z przedmiotowej wypowiedzi mo\u017cna wywnioskowa\u0107, \u017ce resort budownictwa b\u0119dzie sk\u0142ania\u0142 si\u0119 ku wyliczaniu op\u0142aty legalizacyjnej w oparciu o kompletn\u0105, ca\u0142kowit\u0105 warto\u015b\u0107 zamierzenia inwestycyjnego, maksymalizuj\u0105c w ten spos\u00f3b kwoty op\u0142at legalizacyjnych.<\/p><p>Omawianym za\u0142o\u017ceniom ju\u017c na tym etapie zarzucana jest oczywi\u015bcie nadmierna represyjno\u015b\u0107 op\u0142at legalizacyjnych, ale tak\u017ce brak rozr\u00f3\u017cnienia inwestor\u00f3w pope\u0142niaj\u0105cych samowol\u0119 budowlan\u0105 ze wzgl\u0119du na kryterium winy. Oznacza to, \u017ce tak jak w obecnym stanie prawnym, za\u0142o\u017cenia do projektu przewiduj\u0105 takie samo karanie inwestora, kt\u00f3ry chcia\u0142 umy\u015blnie omin\u0105\u0107 proces uzyskiwania pozwolenia na budow\u0119 jak i inwestora, kt\u00f3remu uchylono, udzielone pierwotnie, pozwolenie na budow\u0119 z przyczyn od niego niezale\u017cnych.<br \/>Proponowane zatem zmiany nie dotykaj\u0105 sedna problemu, a jeszcze bardziej pog\u0142\u0119biaj\u0105 represyjno\u015b\u0107 op\u0142at, co zapewne odbije si\u0119 na liczbie dokonywanych legalizacji w jeszcze wi\u0119kszym stopniu.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-af9afa2 elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"af9afa2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
