{"id":4225,"date":"2012-01-30T16:20:21","date_gmt":"2012-01-30T16:20:21","guid":{"rendered":"https:\/\/millercanfield.pl\/?p=4225"},"modified":"2025-04-14T18:03:53","modified_gmt":"2025-04-14T18:03:53","slug":"amendments-in-the-polish-labor-code-as-of-january-1-2012","status":"publish","type":"post","link":"https:\/\/millercanfield.pl\/en\/amendments-in-the-polish-labor-code-as-of-january-1-2012\/","title":{"rendered":"AMENDMENTS IN THE POLISH LABOR CODE AS OF JANUARY 1, 2012"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"4225\" class=\"elementor elementor-4225 elementor-4253\" data-elementor-post-type=\"post\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4148eaba e-flex e-con-boxed e-con e-parent\" data-id=\"4148eaba\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-69319523 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"69319523\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Od 1 stycznia 2012 r. wesz\u0142y w \u017cycie zmiany do Kodeksu pracy dotycz\u0105ce urlop\u00f3w rodzicielskich, wymiaru urlopu przys\u0142uguj\u0105cego pracownikowi, kt\u00f3ry przyj\u0105\u0142 dziecko na wychowanie, terminu wykorzystania zaleg\u0142ego urlopu wypoczynkowego, pracy w niedziel\u0119 i \u015bwi\u0119ta oraz kwestii budowy lub przebudowy obiektu budowlanego, w kt\u00f3rym przewiduje si\u0119 pomieszczenia pracy.<\/p><p>Zgodnie ze znowelizowanymi przepisami, w okresie od dnia 1 stycznia 2012 r. do dnia 31 grudnia 2013 r. wymiar dodatkowego urlopu macierzy\u0144skiego i dodatkowego urlopu na warunkach urlopu macierzy\u0144skiego wynosi odpowiednio:<\/p><ul><li>do 4 tygodni \u2013 w przypadku urodzenia jednego dziecka przy jednym porodzie,<\/li><li>do 6 tygodni \u2013 w przypadku urodzenia wi\u0119cej ni\u017c jednego dziecka przy jednym porodzie.<\/li><\/ul><p><br \/>Ponadto, pracownikowi, kt\u00f3ry przyj\u0105\u0142 dziecko na wychowanie i wyst\u0105pi\u0142 do s\u0105du opieku\u0144czego z wnioskiem o wszcz\u0119cie post\u0119powania w sprawie przysposobienia dziecka lub kt\u00f3ry przyj\u0105\u0142 dziecko na wychowanie, jako rodzina zast\u0119pcza (z wyj\u0105tkiem rodziny zast\u0119pczej zawodowej), przys\u0142uguje dodatkowy urlop na warunkach urlopu macierzy\u0144skiego w wymiarze 2 tygodni. Co wa\u017cne, pracownicy korzystaj\u0105cy w dniu 1 stycznia 2012 r. z dodatkowego urlopu macierzy\u0144skiego lub dodatkowego urlopu na warunkach urlopu macierzy\u0144skiego maj\u0105 prawo do cz\u0119\u015bci dodatkowego urlopu w wymiarze odpowiadaj\u0105cym r\u00f3\u017cnicy mi\u0119dzy podwy\u017cszonym a dotychczasowym wymiarem dodatkowego urlopu.<\/p><p>Zmianie uleg\u0142 tak\u017ce termin wykorzystania zaleg\u0142ego urlopu wypoczynkowego. Od 1 stycznia 2012 r. taki zaleg\u0142y urlop b\u0119dzie m\u00f3g\u0142 zosta\u0107 wykorzystany do ko\u0144ca wrze\u015bnia nast\u0119pnego roku kalendarzowego, a nie jak do tej pory \u2013 do ko\u0144ca marca. Zasada ta nie dotyczy jednak urlopu na \u017c\u0105danie. Urlop na \u017c\u0105danie niewykorzystany w danym roku kalendarzowym b\u0119dzie co prawda m\u00f3g\u0142 zosta\u0107 wykorzystany w kolejnym roku kalendarzowym, jednak\u017ce tylko jako zwyk\u0142y (a nie na \u017c\u0105danie) zaleg\u0142y urlop wypoczynkowy.<\/p><p>Zmianie uleg\u0142 r\u00f3wnie\u017c art. 15110 Kodeksu pracy m\u00f3wi\u0105cy o pracy w niedziele i \u015bwi\u0119ta. Aktualnie praca w niedziele i \u015bwi\u0119ta dozwolona jest przy wykonywaniu prac koniecznych ze wzgl\u0119du na ich u\u017cyteczno\u015b\u0107 spo\u0142eczn\u0105 i codzienne potrzeby ludno\u015bci, w szczeg\u00f3lno\u015bci w jednostkach organizacyjnych pomocy spo\u0142ecznej oraz \u2013 co stanowi novum \u2013 w jednostkach organizacyjnych wspierania rodziny i systemu pieczy zast\u0119pczej zapewniaj\u0105cych ca\u0142odobow\u0105 opiek\u0119.<\/p><p>Wed\u0142ug zmienionych przepis\u00f3w Kodeksu pracy, pracodawca ma obowi\u0105zek zapewni\u0107, aby budowa lub przebudowa obiektu budowlanego, w kt\u00f3rym przewiduje si\u0119 pomieszczenia pracy, wykonywana by\u0142a na podstawie projekt\u00f3w uwzgl\u0119dniaj\u0105cych wymagania bezpiecze\u0144stwa i higieny pracy. Zniesiony zosta\u0142 tym samym wym\u00f3g wyst\u0119powania przez pracodawc\u00f3w o pozytywne zaopiniowanie projekt\u00f3w przez rzeczoznawc\u00f3w. Zmieni\u0142a si\u0119 r\u00f3wnie\u017c sankcja za niedochowanie kodeksowych obowi\u0105zk\u00f3w zwi\u0105zanych z budow\u0105 lub przebudow\u0105 obiekt\u00f3w pracowniczych. Obecnie grzywna w wysoko\u015bci od 1.000 do 30.000 z\u0142 grozi temu, kto wbrew obowi\u0105zkowi nie zapewnia, aby budowa lub przebudowa obiektu budowlanego albo jego cz\u0119\u015bci, w kt\u00f3rych przewiduje si\u0119 pomieszczenia pracy, by\u0142a wykonywana na podstawie projekt\u00f3w uwzgl\u0119dniaj\u0105cych wymagania bezpiecze\u0144stwa i higieny pracy.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a0fd1a0 elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"a0fd1a0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
