Obecnie pracodawca mo\u017ce zawrze\u0107 z pracownikiem tylko trzy umowy o prac\u0119 na czas okre\u015blony, przy czym \u0142\u0105czny okres obowi\u0105zywania tych um\u00f3w nie mo\u017ce trwa\u0107 d\u0142u\u017cej ni\u017c 33 miesi\u0105ce. Ewentualne przerwy pomi\u0119dzy kolejnymi umowami nie maj\u0105 znaczenia. Umowy o prac\u0119 na okres pr\u00f3bny nie s\u0105 uwzgl\u0119dniane przy obliczaniu powy\u017cszych limit\u00f3w. Przy przekroczeniu limitu 33 miesi\u0119cy lub 3 um\u00f3w terminowych, umowa z mocy prawa przekszta\u0142ci si\u0119 w umow\u0119 na czas nieokre\u015blony.<\/p><p>Ogranicze\u0144 w zawieraniu um\u00f3w na czas okre\u015blony, nie stosuje si\u0119 do um\u00f3w zawartych w celu zast\u0119pstwa, w celu wykonywania pracy o charakterze dorywczym lub sezonowym, w celu wykonywania pracy przez okres kadencji. Wskazane wy\u017cej limity nie maj\u0105 tak\u017ce zastosowania w przypadku, gdy pracodawca wyka\u017ce obiektywne przyczyny le\u017c\u0105ce po jego stronie (np. realizacja kilkuletnich kontrakt\u00f3w, projekt\u00f3w terminowych).<br \/>Jednak wskazane wy\u017cej wyj\u0105tki s\u0105 dopuszczalne jedynie, gdy zawarcie umowy w danym przypadku s\u0142u\u017cy zaspokojeniu rzeczywistego zapotrzebowania o charakterze okresowym i jest niezb\u0119dne w tym zakresie w \u015bwietle wszystkich okoliczno\u015bci zawarcia umowy. Ponadto, w przypadku zawarcia umowy o prac\u0119 na czas okre\u015blony w zwi\u0105zku ze wskazaniem przez pracodawc\u0119 obiektywnej przyczyny le\u017c\u0105cej po jego stronie, pracodawca jest zobowi\u0105zany zawiadomi\u0107 o tym fakcie w\u0142a\u015bciwego okr\u0119gowego inspektora pracy. Uchybienie temu obowi\u0105zkowi stanowi wykroczenie przeciwko prawom pracownika zagro\u017cone kar\u0105 grzywny od 1.000 z\u0142 do 30.000 z\u0142.<\/p><p>W przypadku um\u00f3w terminowych zawartych przed i trwaj\u0105cych w dniu wej\u015bcia w \u017cycie nowelizacji obowi\u0105zuje limit 33 miesi\u0119cy, jednak wlicza si\u0119 do niego tylko okres zatrudnienia od dnia nowelizacji (tj. od dnia 22.02.2016 roku). Przyk\u0142adowo, je\u017celi pracownik zawar\u0142 dwie umowy na czas okre\u015blony: (1) od dnia 01.01.2014 r. do 31.12.2015 r. (\u0142\u0105cznie 24 miesi\u0105ce) i (2) od 01.01.2016 r. do 31.12.2016 r. (\u0142\u0105cznie 12 miesi\u0119cy), to w przypadku zawarcia kolejnej umowy od dnia 01.01.2017 r. na czas 18 miesi\u0119cy, b\u0119dzie to trzecia umowa terminowa, kt\u00f3ra nie b\u0119dzie podlega\u0142a przekszta\u0142ceniu w umow\u0119 na czas nieokre\u015blony gdy\u017c, okres zatrudnienia liczony od dnia 22.02.2016 r. nie przekroczy limitu 33 miesi\u0119cy.<\/p><p>Je\u017celi chodzi o spos\u00f3b liczenia liczby um\u00f3w, to umowa trwaj\u0105ca w dniu 22.02.2016 r. b\u0119dzie uwa\u017cana za pierwsz\u0105 umow\u0119 albo za drug\u0105 umow\u0119, je\u017celi zosta\u0142a zawarta jako druga umowa zgodnie z dotychczasowymi przepisami (tzn. przerwa pomi\u0119dzy rozwi\u0105zaniem pierwszej umowy a<br \/>zawarciem kolejnej nie przekroczy\u0142a 1 miesi\u0105ca). Zatem je\u017celi pracownik zawar\u0142 trzy umowy na czas okre\u015blony: (1) od dnia 01.01.2014 r. do 31.12.2014 r., (2) po trzymiesi\u0119cznej przerwie od 01.03.2015 r. do 31.12.2015 r. oraz (3) od 01.01.2016 r. do 31.12.2016 r., to umowa nr (3) b\u0119dzie uwa\u017cana za drug\u0105 w rozumieniu nowych przepis\u00f3w. Natomiast gdyby strony zdecydowa\u0142y si\u0119 zawrze\u0107 kolejn\u0105 (czwart\u0105) umow\u0119 na czas okre\u015blony po rozwi\u0105zaniu umowy nr (3), to w \u015bwietle nowych przepis\u00f3w b\u0119dzie ona traktowana jako umowa trzecia.<\/p><p>Poczynaj\u0105c od dnia 22 lutego 2016 roku zmieni\u0142y si\u0119 tak\u017ce zasady wypowiadania um\u00f3w o prac\u0119 zawartych na czas okre\u015blony. Przed nowelizacj\u0105 mog\u0142y by\u0107 wypowiadane tylko umowy terminowe zawarte na okres przekraczaj\u0105cy 6 miesi\u0119cy i o ile strony przewidzia\u0142y w umowie tak\u0105 mo\u017cliwo\u015b\u0107.<br \/>Okres wypowiedzenia wynosi\u0142 zawsze 2 tygodnie. Obecnie okres wypowiedzenia um\u00f3w terminowych jest uzale\u017cniony od okresu zatrudnienia (sta\u017cu pracy) u danego pracodawcy i wynosi: 2 tygodnie, je\u017celi pracownik by\u0142 zatrudniony kr\u00f3cej ni\u017c 6 miesi\u0119cy; 1 miesi\u0105c, je\u017celi pracownik by\u0142 zatrudniony co najmniej 6 miesi\u0119cy; 3 miesi\u0105ce, je\u017celi pracownik by\u0142 zatrudniony co najmniej 3 lata. Strony mog\u0105 wypowiedzie\u0107 umow\u0119 bez wzgl\u0119du na to czy zawiera ona klauzul\u0119 wypowiedzeniow\u0105.<\/p><p>Pewne w\u0105tpliwo\u015bci mo\u017ce budzi\u0107 obliczanie okres\u00f3w wypowiedzenia um\u00f3w trwaj\u0105cych w dniu wej\u015bcia w \u017cycie nowelizacji (tj. w dniu 22.02.2016 roku). Zgodnie z przepisami przej\u015bciowymi, do um\u00f3w o prac\u0119 na czas okre\u015blony zawartych na okres do 6 miesi\u0119cy albo zawartych na okres d\u0142u\u017cszy, ale w kt\u00f3rych nie przewidziano mo\u017cliwo\u015bci ich rozwi\u0105zania z zachowaniem 2-tygodniowego okresu wypowiedzenia (brak klauzuli wypowiedzeniowej), trwaj\u0105cych w dniu wej\u015bcia w \u017cycie ustawy, w zakresie dopuszczalno\u015bci ich wypowiedzenia stosuje si\u0119 dotychczasowe przepisy. Oznacza, to \u017ce formalnie umowy takie nie mog\u0105 zosta\u0107 wypowiedziane. Natomiast do um\u00f3w zawartych na okres powy\u017cej 6 miesi\u0119cy, w kt\u00f3rych przewidziano mo\u017cliwo\u015b\u0107 wypowiedzenia stosuje si\u0119 nowe okresy wypowiedzenia. Jednak w celu okre\u015blenia d\u0142ugo\u015bci okresu wypowiedzenia nie uwzgl\u0119dnia si\u0119 okresu zatrudnienia przed 22.02.2016 r.<\/p><p>Na przyk\u0142ad, je\u017celi umowa zosta\u0142a zawarta na okres 2 lat od dnia 01.01.2015 r. do 31.12.2016 r., a wypowiedzenie zosta\u0142o dor\u0119czone pracownikowi w dniu 20.06.2016 r., to okres wypowiedzenia wyniesie 2 tygodnie, gdy\u017c sta\u017c pracy, liczony od dnia 22.02.2016 r. jest kr\u00f3tszy ni\u017c 6 miesi\u0119cy.<br \/>Jednak gdyby wypowiedzenie zosta\u0142o wr\u0119czone pracownikowi w dniu 20.09.2016 r., to okres wypowiedzenia wyni\u00f3s\u0142by 1 miesi\u0105c, gdy\u017c sta\u017c pracy liczony od dnia 22.02.2016 r. wyniesie co najmniej 6 miesi\u0119cy, ale b\u0119dzie kr\u00f3tszy ni\u017c 3 lata.<\/p><p>Natomiast dla potrzeb ustalania d\u0142ugo\u015bci okresu wypowiedzenia um\u00f3w terminowych zawartych od dnia 22.02.2016 r. poczynaj\u0105c, uwzgl\u0119dnia si\u0119 sta\u017c pracy przypadaj\u0105cy przed dniem wej\u015bcia w \u017cycie nowelizacji, bez wzgl\u0119du na przerwy w zatrudnieniu i rodzaj zawartej umowy o prac\u0119.<\/p><p>Przyk\u0142adowo, pracodawca zawar\u0142 z pracownikiem kolejno dwie umowy terminowe w nast\u0119puj\u0105cych okresach: (1) od 01.01.2015 r. do 29.02.2016 r. oraz (2) od 01.03.2016 r. do 31.12.2017 r. W dniu 30.06.2016 r. zostanie dor\u0119czone pracownikowi wypowiedzenie. Okres wypowiedzenie wyniesie 1 miesi\u0105c, gdy\u017c sta\u017c pracy liczony od dnia 01.01.2015 r. wyniesie co najmniej 6 miesi\u0119cy, jednak mniej ni\u017c 3 lata.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b12bfee elementor-alert-info exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-alert\" data-id=\"b12bfee\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">\u00a9 Miller, Canfield, W.
