Our law firm provides day-to-day services to clients in matters related to bankruptcy law and restructuring law. The Bankruptcy and Restructuring Law Team advises both creditors on pursuing claims from contractors in bankruptcy and debtors on restructuring enterprises. The above actions are taken as part of bankruptcy law procedures as well as at the stage preceding the declaration of bankruptcy.
Team of our lawyers comprises of lawyers holding a restructuring advisor license authorizing to perform a function of court receiver in bankruptcy proceedings, as well as a restructuring arrangement supervisor, a court supervisor and a court administrator in restructuring proceedings.
We advise and represent business entities from the moment when the insolvency risk arises, at all stages of bankruptcy proceedings as well as restructuring proceedings.
We provide legal advisory services in the field of bankruptcy proceedings, including a stage of preparation the company for submitting bankruptcy as well as a stage of conducting bankruptcy proceedings. We advise Clients as well in all types of restructuring proceedings in the event of insolvency or threat of insolvency, including proceedings for the approval of an arrangement, accelerated arrangement proceedings, arrangement proceedings, remedial proceedings aimed at taking remedial actions by the debtor.
Within the above field we provide among others the following legal services:
- legal advice, both for creditors and debtors, at the stage of threat of debtors' insolvency, by preparing the company for bankruptcy or restructuring and appropriate arrangements with creditors in this respect, including assessment of a risk relating to arising of a basis for submitting a bankruptcy petition or a petition for instituting restructuring proceedings;
- preparation of a bankruptcy petition and a petiton for instituting restructuring proceedings;
- filing pleadings as part of bankruptcy and restructuring proceedings, including filing claims with the bankruptcy estate;
- legal advice on the formulation of arrangement proposals and preparation of relevant documentation in this respect;
- representing the Client at meetings of creditors in the matter of agreeing on arrangement proposals;
- representing creditors at creditors' meetings and in the creditors' committee, also as the Client's attorney;
- pursuing receivables as the Client's attorney as part of bankruptcy proceedings;
- concluding and performing agreements with a contractor in bankruptcy and in restructuring proceedings;
- the legal consequences of declaring a bankruptcy or instituting restructuring proceedings for the contracts concluded by the Client with the counterparty in relation to which the bankruptcy has been declared or restructuring proceedings have been instituted;
- concluding contracts with a counterparty threatened with insolvency and thus in respect of which bankruptcy may be declared;
- acquisition of assets of bankruptcy as part of bankruptcy proceedings, including as part of a prepared liquidation, in particular the acquisition of a business as a whole, the acquisition of assets of a business or the acquisition of real estate.
