Michał Szlachciak is a licensed legal advisor and tax advisor, of counsel in the Warsaw office of Miller Canfield. A graduate of the Faculty of Law and Administration at the University of Warsaw and postgraduate studies in accounting, organized by the University of Finance and Management in Warsaw. He has participated in numerous training courses in the field of tax law as well as administrative and court procedures.
He gained his professional experience in cooperation with a Warsaw notary’s office, a tax advisory office and a law firm of advocates and legal advisors. Michał provides services in the field of tax law (with particular emphasis on VAT, PIT, CIT and real estate tax). His domain is to represent clients in disputes with tax authorities in the course of tax audits, customs and fiscal inspections, tax proceedings, including security and enforcement proceedings. He also represents clients in proceedings before provincial administrative courts and the Supreme Administrative Court. It also provides tax advisory services for both Polish and foreign clients.
His professional experience includes, m.in: recovery of unduly collected PIT and VAT from a natural person trading on the Internet and effective conduct of compensation proceedings against the State Treasury; recovery of an unduly withheld VAT refund in the amount exceeding PLN 2.5 million for an entrepreneur from the commercial sector; discontinuation of tax proceedings concerning the so-called “carousel fraud” against an entrepreneur from the commercial sector; conducting multi-faceted proceedings regarding withholding tax (WHT) on dividends paid to a foreign shareholder of an entrepreneur from the development industry.
Michał also provides comprehensive support in the field of real estate trading, taking into account civil, administrative and tax aspects. He represents clients in court, administrative and administrative court proceedings concerning the regulation of the legal status of real estate (including complex cases of acquisitive prescription).
He is fluent in English.
